I said should cukur get 13th month salary but my colik said we deserve it...he angry he only get 3 months bonus exclude 13th month....
He said he deserve min 4 months based on company performance....
Yes or no?

Anything beyond the stipulated 12m is a bonus.

in american company financial accounting ...it is no. 13 or 14th month is total salary package therefore consider as salary. however, the 13th month is tricky because it is use in some company as leverage.......to keep you from leaving. Some pro-rated while some don't give at all if u tender before bonus payout

That one contractual bonus..so considered as bonus la..+ 3 mths performance bonus = 4 mths

always 12 months in a year. never more, guaranteed less

This is what i told my colik/senior... but he said 13th month salary every1 deserve it...
He even told me he nvr work before in a company tat nvr pay 13th and company who do not include 13th month in salary package dont deserve his service....

Some other countries like UK, they are paid weekly. In a year there are 52 weeks. So if you divide 52 by 4 you get 13 months. In HK, salary is paid monthly and some company will pay you 13th month and its stated in the contract.

13 month salary came about as usually there is 4 weeks in a month. So a year will be 48 weeks. Since I a calendar year is 52 weeks hence the 13 month salary.

However most company treat this part of your bonus instead of due salary.

13th month pay is contractual.
