 Repainting whole building !, Opinions on possible exposures...

Hi forummers,....

My tenant has been renting with me for a number of years.

Today they are asking for approval to repaint the whole building with a different color than the original white.

What are the possibly future exposures to this matter ?

Would appreciate opinions from other landlords and landladys here,...

What my bos do is:

1) If the colour is tenant choice it would be tenant will be paying. Cannot deduct from rent.
2) If the colour is my bos choice, she will bear the cost and all + theres a increasing rent

I think is better to reject them. They won't repaint after they want to leave for other properties. Unless you ready to repaint by yourself with your own cost.

They just tell you or make an excuse that next tenant may like it or it is very expensive to repaint original white color.

Tq,... It's actually an office bldg. Yeah,.. I may need to repaint to white color later.

I'm thinking of estimating the cost of repainting back to white color,... and then increasing their deposit based on this estimate first. After they have topped-up the deposit,.... then only allow them to repaint.

There is in fact another consideration here : it's nearing year-end, I may increase the rental later. I'm a bit boggled on how to sequence this event in,.... rclxub.gif

Well, they never did ask us to chip-in, they just asked for my approval to paint the building to their desired colors,... I believed it's fro their business purposes, to make it more attractive. Hence,... I believed they will fork-out to paint first. But what if we need to revert to original color later,... that's the hard part, right ?

And,... then I increase the rental,.. it's not very nice for the tenants,... what's a good behaviour for tenants ??

if dont want to increase the rental why not make renew agreement to them mention about if they leave the premise they have leave same as what it is...and if failed to do so the deposit consider burn...that what i know last time my boss rent office at kl...they mention at contract..

Tq again,... the current Lease Agreement that I have with the Tenant says that they have to do back as original when they leave,... but of course save for wear and tear,.. the thing is we are not sure how much it will take to re-paint back to original white when they leave, which means the current deposit that I am holding may not be sufficient to cover the repainting should they leave later.

Then again,... abt the rental increase at this year-end,.. it would be better to notify them first of the possible rental increase before they paint,.. or let them paint first ?? Then only inform of rental increase at year-end ??

I have spoken to my tenant,... they don't mind the rental increase if it is within mkt rate of the area, they just wanted to PAINT THE WHOLE BUILDING.

Hence, I will generate an addendum to my current Tenancy Agreement with them, collect more deposit and let them paint.

They can start first if they wished to,... I will increase the rental at year-end appropriately.

From all these signs, I read they really loved my location,....

Updating here again on the above : my Tenant started painting the whole building BEFORE I forwarded them my approval. They claimed they can't wait for my instructions anymore,.. THey said they needed to do business, can't wait forever the Landlord.

This, well,... constitutes a breach in my Leasing Agreement with them,... but,.. well, I am not here to initiate litigation against them though I can start the process already.

I may increase the rental at come year-end,... but may not too since they are such good paymasters.

Would appreciate some opinions from other landlords and tenants here too on what you would do moving-forward from here.
