Just curious to know... do any of the members in this forum ever get back the "cukai terlebih bayar" from LHDN.... and if you does, how do they transfer the money to you?

probably u need to go there and ask for cheque

btw, ur one unique case, normally people dont overpay taxes

Normally ppl will overpay because company deduct the tax form payslip everymonth. WHen year end you calculated, you mostly will overpay.

I never get back my money as well. zzzzz

Mine was overpay as well. After deductions from insurance, books etc, there is "cukai terlebih bayar". You need to go to LHDN office, and sign a letter asking them to refund the balance to you, or use it to offset your current tax (if any).

The last time I request for a refund, it took about 9 months for the cheque to arrive sad.gif.

Hmm .. I heard it takes 2 years for the refund. They will mail you to go to collect the check or something.

I have overpaid taxes last year but this year I have to pay them back, how am I supposed to know they will offset my taxes?

I got a cheque last year because of overpaid. Nowadays, you cam put your bank account number in the form and I think they'll bank it straight away.

I been told we need to fill in a request form before they will return your monies to you. Also, don't expect it to come anytime soon. You're NOT allowed to use it to offset the following years' taxes.

Don't ask me why but apparently, that's how the system is *shrugs* sad.gif

Prepared the cheque for refundlah. However you must be sure of the amount coz if you use it to set-off this years tax but under audit it is determine that your tax credit is less than you have calculated than you would have underpaid this years tax!!

1st check from the counter do you have extra $$ in there. If yes, fill in form to request refund.......Normally will take >3months

Check mail to your home...........

Ugghh i don't think you can do that. You're not allowed to deduct yourself without LHDN approval, even though your calculations are right. sad.gif

Yes you can thats what is known as self assessment. However just for any excess tax to be paid , not for PCB deductions.

Don't offset...thats my advice...what ur consultant says its true....IRB balance and payment in ur account for YA2003 and below is still under final assessment stage, meaning that all ur backlog dues and tax payable are being reassess for finalization....the amount can't be used to offset future settlements...

Y/A 2004 & 2005 excess payments will be refunded almost asap...i got mine within 3 mths of submission

Overpaid tax can't be offset by next year tax. They treat each year separately, can't just use last year credit to offset this year taxable amount.

Means that if 2005 you overpaid Rm100 and this year your tax is 1,000, you still need to pay 1,000 first then file a claim back of previous 100. You can't just pay 900. If you pay 900, they will treat as underpaid and can be penalised.

I don't have any problems with Income Tax Dept so far, they always refund my excess PCB deductions, sometimes automatically, sometimes give them a call. All the while I've maintained my file in my home town. Small town less files less work to do, my file got processed faster. I also make sure I return my forms in March although the final date is 30 April.

I think it is important to take the initiative to open a file with the Dept once started working even though not taxable. When your file is in order, they don't need to refer to previous years when assessing the current year, and so they can complete the assessment in a short time. We have to think that these officers always go for training, leave, mc etc and transfer here and there, so the moment if they need to refer to previous years info, then it will take a very long time.

You can't open a file if ur non taxable....they'll reject ur application on the spot...by law, if u have chargeable income, u should be filing ur tax returns...but then, the officers won't open a file for u if ur not taxable for the year

Yes you can. You have the right to ask them to open a file for you. If they still insist you can't, I think the only reason they say no is to avoid doing extra work.

My junior colleague who started work in July 2005 only earns RM12K for the 6 months and logically not taxable, but she managed to have an income tax file open for her in 2006. However once you have a file open, you must make sure you file the return irrespective of taxable or not.

My own Income Tax file was open not because I have started working or have any income, but because I want to claim back the 28% tax that have been deducted from share dividends. And I always get those money back from IRB.

There is no law which says a file must be open if there is no reason to open one notwithstanding dividends, CKHT purposes etc. IN fact for those who already have a file but income less than RM 20k (again not withstanding dividend income) you would have received letter from IRB informing you not to file unless your circumstances have change(ie suddenly you got big promotion/income rclxms.gif ).

or go straight to the branch ( where ur file is ) n ready for crowd .

recommend you go to KL LHDN branch... near to Maharajarela monorail station, they are friendly and their working efficiency is quite high, I went there few days ago biggrin.gif

As i know, only corporate tax can do so. That means only those Sdn Bhd/Bhd can use credit to offset instalments. For individual tax, you can't do so because they won't give you approval letter. If you really did not pay the instalment, they will charge you 10% penalty. It's better to pay all the instalments and write letter to ask for refund if overpayment.

Just wanted to ask, coz I don't have any record for income tax yet, and wished to do income tax by next year. If my basic salary is RM1700 gross, i'm not taxable but do I need to pay anything if I file a income tax?

yaya and for ur information the company has to deduct for the pcb once ur salary hits 3k and by law employers should and thus there is no way that you could ask irb to set off ur income against your tax credit sad.gif

no worry, they will target those rich people first...

btw, last time ask lhdn people before, kena tax only go open account, else no nid....
