But can I say they actually got counter check mechanism which is under processing they view the error and withdrawn the sales?Ex:if you buy something in it stall in lowyat,the price label is different with their system price,they can withdraw it if the want.

In this case, i have same opinion too, when it happened to me before.

Until.....i found there is a terms & conditions stated that they have a right to cancel the order.

If every shop comes out with own TnC, then what's the use of case study? The judge also must rule according to previous ruling if there is, that's the use of english law in Malaysia. =)

Apart from those groceries,some it hypermarket overseas also wouldn't sell you the item if the price different is too big until they verify which is the true price.Big price item,not everyone can bear the loss.That's why they will say their cashier or something else is their counter check mechanism.

Err, I don't think the merchant need to honor the lower price. If I remember contract act section 2 correctly (5-6 years uni course). The item display is an offer, is up to the customer to accept it. The moment customer pick it, legally It term as ITCLR?

If I am not wrong again for hypermarket case, ITCLR happens when customer bring the goods to cashier counter.

as i said, no legal law pertaining to contract in Malaysia that proved this exclusion clause. correct me if i am wrong.

same case like the "Goods Sold are not Returnable". If you purchased an item not in good condition or not same as spec, can you return? Yes, of course you can because the law does protect you from the misinterpretation and liability for defective products.

However, in this case, they accepted our offer, which is acceptance. Once acceptance take place, it ain't easy to revoke unless mutual agreement reached.

I don't have an intention to flood this thread with legal discussion.

But u should see back the essential point to form a contract. Simple as that.

I'm no law expert... but as far as I know to form a contract, it's to be on good will, both party consent and consideration... actually there r 5 elements to fulfill but forgotten the other two
