I think better to have closed group facebook to discuss this within owner..just owner..may share everything there with quicker respond i think

not ask you to argue. but gather the buyer crowd and pressure the developer to solve it quick
so i advise you to create watsapp or FB group to discuss the strategy and work together to pressure the developer.
im here to help not to proof im better.

Refer to your SPA. It should be the prescribed Schedule H according to Housing Development Act. If it is, then you are entitled to payment of LAD immediately upon VP.

If not, pls bring your case to the Housing Tribunal.

Refer to SPA Sch H, Clause 25.(2). LD is based on 10% per annum of the purchase price.

On your second issue, as DIBS is not a standard specification in Sch H, you will need to read the fine prints of any supplementary agreement governing the DIBS. If it is not mentioned specifically DIBS can be used to offset the LD, then they cant.

You should seriously approach HBA already.

just heard from Shu Tai, the lawyer firm that 10% of owner accept macvilla offer (reno+tv). They will entertain that first

maybe..we also did not get that offer..but we received letter from shu tai earlier last week. Macvilla opted to pay RM5000 only instead of LAD total payment..just went to KPKT and report to the tribunal

I dont think so because we call the lawyer but Ms Ho like dont know anything and also dint not offer anything to us.

I did met some owner, same offer they provide but the end also not news.

So did you went to KPKT and report to tribunal already? When will be your hearing? mine will be on end of this month. Let see what will happen. Not happy with opted RM5,000 payment from Macvilla thru Shu Tai letter.

Im an owner as well and I've actually engaged a lawyer and already sent demand letter. I think KPKT tribunal can handle max RM50k only so if beyond that you need to use a lawyer.
I would like to be included in any owner-only chatroom as I would like to work together else we all won't get our LAD etc.
