As some forumer suggested, use the Landscape mode and closest focusing. This will cause the camera to choose a "dark" aperture and focus on the person (being closer than the background). As discussed, due to the aperture setting, the Depth of Field will be deep, and it should be deep enough to encompass both the subject and the background.but should I focus on the person or the mountain?

As for opening NEF files in Photoshop, you will need the Adobe Camera Raw plugin available as a free download from Adobe. However, you maybe out of luck if you have the Nikon D40 as the latest version of ACR (v3.6) doesn't support the D40. Probably have to wait for the next version, (won't be long, any day now). All other dSLRs from Nikon are supported by ACR v3.6.
