spec sheet max temp means the maximum it can go, limit of its operation. the software detected max temp is the highest temp it has recorded from the hdd, so your hdd is still working fine

What app are you using to backup from phone to NAS? Cloning to the second HDD may not be as safe since it is running on the same system, any hardware failure affecting one HDD will affect the other too. Nonetheless still an extra backup copy in case primary failure. Add also periodic SMART tests on both HDD to check their health
