 Refund deposit to buyer, refund deposit or not ?

A buyer pay RM5,000 deposit to buy my condo, the day i receive the deposit is on 14 July 2016. But 2 months later, 14 September 2016, my property agent said the bank reject buyer loan and agent show me the bank loan reject letter of buyer.

After that, property agent want me to fully refund RM5,000 to buyer. I know fully refund is a must if loan rejected.
But the buyer took 2 months time to let me know. Show i refund deposit to buyer ?

I'm very unhappy because i reject all other potential buyer within this 2 months. If buyer only spend 1 month time to let me know bank reject his loan, of coz im still willing to fully refund RM5,000 to him.

My property agent keep on calling me for every 2, 3 days for deposit refund.

So, shall i refund deposit to buyer ?

I'm sure if the buyer knows his loan got rejected he would wants his deposit back ASAP ... the delay might be on the banks' side

From what i know, bank loan just need 1 weeks times to 3 weeks to get the aprroval. But buyer took 2 months to let me know the answer.

For myself, almost every approval of my loan just need 1 weeks or less than 2 weeks.

Did you accept and sign any offer to purchase upon accepting the RM5,000 deposit?

If yes, is there any clause stating that the RM5,000 to be refunded to the buyer if he fails to obtain a loan? And whether there is a time frame stipulated for the buyer to obtain loan?

then you have no choice but to refund. in future to avoid buyer from delaying, just insert a timeframe console.gif

You have your own reason, so do the buyer. To prevent any further conflict, you have to refund.

Go by the law. Just refund. Lesson learned.

Check you deposit receipt. Some agency has 14 - 30 days to get loan or else forfeit deposit. If there is this clause, refund is all on your courtesy. If no, then trouble free is to refund lo
