 Claim from stakeholder for house defects

Hi to all,

I have purchase landed house at Melaka and VP delivered on 18 Jan 2016. After that, like usual, fill up all the defect list form and gave to developer to rectify it. My problem:
1. Until now (august 2016), not all defect is been fixed. I have fill 3 times the defects form (all dated) and send to them.
2. Defects repair that been carried out is more like hiding the problem instead of actually fix them.
3. House feature listed in sales brochure not the same as actual house. Some features is missing (example: rainwater harvesting system) and when asked, they (dev) reluctant to give it since not in S&P.
4. Based on other house owner feedback, electric wiring/harness required electrician to fix (example: default wire too short. wire have wrong color coded and wire earthing might not properly done). Plumbing also require some work to rectify leakage.

With all this problem, I been thinking to actually get remaining 5% from stakeholder and get my friend (small time contractor) to rectify the defects. Now, do you have guide on proper procedure for me to get the money from stakeholder? any downside if i go this route? like no more warranty from developer? Or any other suggestion?

Thanks for your reply. Some of my question is answered there but left me few more question. Example, let say remaining 5% is equal to 20k and quotation from contractor is around 10k, does the stakeholder disburse all or only base on quotation given?

If i already claim from stakeholder, does developer can denied more defects claim during warranty period?

Stakeholder disburse only base on quotation given.

Developer can denied any defects claim if they want.

I already send letter to stakeholders to withhold remaining sum. They (developer) said by phone that they will repair it.

Now is already more than 14 days since my letters to them (stakeholders & developer) and all my defects was not rectify. How to claim the money or does developer have power to deny my request and they take their sweet time to rectify it?

Read your SPA, it is mentioned there when can you start claiming your quotation money
