Hello guys,

What is the process of buying a limited car in Malaysia?

Here's my past event :
1) Go to showroom and make booking - Done.
2) Sales man apply my loan - Done.
3) Loan approved - Done.
4) Down payment - *Going to make tomorrow.

What the sales person told me is that I have to make down payment first before he can allocate the car, still not sure is it available yet.

Is this really normal? If I make down payment and fail to allocate the car for me, how long normally they take to refund?

You signed the loan agreement?

By right, car is allocated before you sign the loan agreement. And after signing only you pay the d/p.

the car is allocated only when full payment is made (agreement signed and balanced paid).

loan approved doesn't mean they will allocate, if they do that then when customers cancel they are stuck

What I did when I bought my previous 2 cars, was that I told the SA upfront that I will not sign the loan agreement without a chassis number.

Tell them to allocate to you your car, else you will not sign the agreement nor pay the D/P, and you shall take your business elsewhere.

why would they be stuck? By right the car should already be in their stockyard. If the customer cancel then just take the 10% of the booking fee that they are legally entitled to, then sell the car to someone else.

Yup, I agree. When I bought my car two months ago, the car was allocated to me as soon as I paid the booking fees.

Here's some general rule of thumb - even if its limited (I'm a Mazda & Peugeot Sales)

1. Loan agreement to be signed, booking fee paid irrespective car allocated or not.

2. Balance down payment should only be paid if a chassis number is allocated. This is common practice to ensure car is available before parting with your money.

In case they can't allocate the car after the downpayment is made, and come up with excuses to delay the delivery, there's the scenario where customer is stucked, cancellation will only makes matter worse.

Another way, is to call Subaru HQ to confirm the SOP of downpayment. As for the 2 brands I'm handling, no chassis number, we don't collect the balance D/P from customers.

Of course, certain clients don't mind paying early in order to secure faster delivery.

QUOTE
The issue that sparked the most debate was the restriction to allow dealers to collect a maximum 1 percent of total selling price booking fee mandated by the amended Act. They would also have to refund 90 percent of the amount back to customers if the deal failed to materialise. In the past, car dealers collected a booking fee before a loan application is made to the bank. Under the amended law, car sellers or dealers cannot accept booking fees before the car buyer is served with a Second Schedule notice.

A Second Schedule notice can only be completed and served in practice, on the car buyer usually after the hire-purchase loan application is approved. Therefore, the remaining 9% down payment on the car can only be paid when the hire-purchase agreement has been prepared, with details such as the car’s chassis number included. In addition to this, banks are only allowed to prepare the hire-purchase agreement after the actual car unit has been allocated to the dealership. To enable this, car dealers would have to cough up their own money to book the cars from the principal. This is the main worry for dealers and the reason why many have complained about the new amendments.

The 2011 amendment to the HP Act was enacted to protect consumers, many dealers prey on the customer's ignorance on this matter to secure sales even without stocks. Feel free to bargain with your dealer to ensure a car is allocated to you ASAP, but understand also dealers need to cari makan so maybe you can give or take a bit so both parties are happy.

Bro, what Subaru cars you order? Is it from Motor image or official distributor or Re-con AP holders?

XV and Forester is a lot nowadays due to CKD. Only certain popular color will need to wait.. Currently the Forester for some color need to wait for 2 months due to hot demand now..

When purchase of car, usually they will allocate the cars after the payment & loan approval are done. Loan approve only they will not proceed, as anytime you can also cancel your loan. BTW, your loan will only start once you get your car.

If Xv / Forester they can ask their HQ to sent the car picture for you on availability stock, but chassis no. they wont share as anyone which get the payment done early will allocate for them first.

You can get official receipt from them regarding the payment done. But if want to cancel, they might charge you a 10% of admin / cancellation fee (From the initial booking fee).

1) I will only make down payment, no need to sign for the loan, then they can check the car allocation within 10 days.

2a) If pass ok loh.

2b) If fail, will took me 'fastest 1 month' to refund.

3) they will confirm car allocation with chassis no. included, then only i sign my loan.

My family already purchased 1 Xv from Motor Image, BM Penang branch last year and book the forester again this year.

We only pay for booking fee and awaiting for loan approval. Once loan approve, you will have to pay the initial front payment to them.

They will issue the official receipt for you. Advise is to do it in their office to get all the documents. Dont always trust the SA to settle all for you, sometime they might do error also.

If you purchase from official branch or distributor dont have to worry much. They will help you to proceed, as their commission will only get once you get to drive the car out from their branch.. nod.gif

You can sign the loan any time you want. The money will not be disbursed until all conditions have been met. The loan can also be cancelled or transferred to another dealer.

Get the engine/chassis no. first before you make the down payment. This means the car is allocated to you and on its way. You can also insist that the car has arrived in the showroom for you to inspect before making the down payment.

If the dealer insist you must make down payment first before car allocated to you look for another dealer. This is not the normal procedure.

Yes I'm purchasing from official branch, Subaru @ Cheras.
What can I do anyway to ensure mine would be submit faster than other because the SA always reply with 'management told, management advise, management...', every word come with management..., tried my best to get loan approve within 2 days time, now they only tell me such procedure.
Call up management people would make thing help?

Yes, is better to direct go to office and talk, especially the branch manager. From what i know the Russ Swift road show demo car is limited and a lot of people are showing interest for it due to cheaper price tag.

Sorry to tell, but if the last car already sold off they might ask you to take for other (Maybe test drive unit) or newer car model. Got a few person already kena this scenario already these few days..

well... thats the price to pay for 30k savings I guess.

put it from the perspective of the SA, there are X numbers of cars and all the SA are selling them. these cars are flying off the shelves like hot cakes and they need to secure it ASAP, basically a case of SA vying with other SA to get the cars.

not saying its the proper way to do things, but such is the reality of a good deal. lol...

Banks only need the vehicle sales order and your supporting documents to do the loan. They do not need to wait until a car is allocated to you.

When you sign the loan is immaterial as long as it is before the vehicle arrive in the showroom. Otherwise it may slow down handover of the car. If you have signed the loan and you get fed up of waiting you can transfer the loan to another dealer or cancel it.

When you apply for loan, you only need to state the amount and for which car model you intend to apply the loan for.

Once the loan is approved, the bank will issue the letter of undertaking (LOU). After you agree to the terms of the loan (interest rates etc.), then only the HP agreement is prepared. It is in the HP agreement that the chassis number must be present.

You walk int McD

You order a set of Double Cheese Double, with large fries and coke.

You get free sundae cone by paying with debit card.

After you swipe the card, manager told you to come back in a few day time to collect the item.

I assume you will agree to do so? rclxms.gif

You'll have to ask those banks and dealers who let their customers sign the HP agreement without a chassis number.
