 URGENT HELP ( maintainance fees issue )

Hi, seeking some expert advise. I'm renting a condo in Puchong. Earlier of the year received a letter from management office stated my access card will be barred due to the owner have overdue maintainance fees. ( I get shock, because I know the owner is quite rich owning few houses and he himself even staying in a bangalow and working as a higher management ppl in a MNC company.) Calling back to the owner ask about it the owner say previously all the while the JMB will sen the bill to his house but for quite sometimes he didn't received the bills. He ask me to ask the JMB to call him back. After clerification, I inform the JMB on what did the owner told me, hence the JMB say they did sent those bill, and call the owner but can't contact the owner. ( for more than 3 years I know the owner as I know he didn't change his number ). At that time, the JMB unbarrdd my access. But good day won't come long, after 1 and half month which now, received a letter again from JMB saying my access will be barred soon because they unable to contact my owner.

Question here.
1) can the JMB really barred my access card which I'm only the tenant not the owner of the house. ( they barred the access card is to create problem to the owner but in my case here, the owner will not get any troublesome on it )
2) is it really legal where they barred my access card ? ( going to discuss with my lawyer in further )
3) for the condo I renting, we need to touch the access card to go the our floor, I heard the guard say the JMB asking the guard not to touch for us, hence ask us to use staircase to our floor. ( gosh, I'm staying 17 floor !! )

yes the management can bar ur access card.

Unfortunately for you, the problem is with your landlord, not the JMB. Sounds like they've been very kind to you for granting you the grace period.

U tell owner u will use the rental to pay management fee if thy barred u

In most tenancy agreement, there should be a clause which says landlord are obliged to pay maintenance fee to allow tenant hassle free stay, else the tenant have every right to take legal action against the owner.
You need to pressure the owner to pay up or else you will find another place to rent

yes I will do that as well...the management office does have the power to block access card for non payment
of maintenance fees.

in the first place after you have called him regarding this matter he should have gone and pay for the outstanding instead of asking you to tell the office to call him !

what kind of chapalang owner is this? adui

yes, of course they have every right to bar. No point talk to your lawyer. You just need to give them the owner contact. Maybe they have the old contact.. Or set up meeting with owner and JMB. Else solve with your owner dont pay him rent.

YES OFCOURSE.. Currently JMB is having issue with the owner and why he need to care about the tenant.. janji he can done his job then ok..

Yes it legal, As owner didnt pay up for the fees.. it called bad debt.. and owner only own the unit.. not the whole unit/lift

Maybe the only solution u can try is go meet with JMB and on the spot u call the owner let them talk about it

Dont think the JMB too free want to simply bar your access. So many other residents wont only kacau you.

You have to discuss and act amicably with the owner. Clearly this was his arrears to the fees.

One thing can expedite and solve, use the rent to cover for the fees first, so that you can use the access card. The owner has to in whatsoever to provide you with usable access card.

I've run into similar scenarios when managing owner's properties as its my bread and butter. Give the owner the benefit of a doubt. The one's i encountered was so busy with their own career that they really don't have time to deal with these issues hence they contracted my services.

So, the fastest way to solve this problem is to call up the owner, inform him that you will use the following month's rent to offset the outstanding maintenance fees. Most owners will be happy that you do it for them. If not enough to offset then use the following month rent as well. You can jungle with the time frame with maintenance office. As long they get some sort of payment they are happy.

If the owner rejects your proposal, then something is wrong somewhere. Better investigate thoroughly before jumping to conclusions.
