 permit/license for food restaurant/online, necessary ones?

are there any license or permits required for selling food at pop ups/flea market and online? We are a food start up looking to sell food in flea markets first and also maybe test out the online market like food delivery. i.e: dahmakan.com and the likes of it. Any input will be greatly appreciated. Thanks!

From SSM, highly recommended to get it. Plus it's like RM60+ a year only.

From local council, maybe not.

garlicpesto,

If you are just testing out in flea markets, you do not need to be a registered entity. Just go and apply for a booth as yourself.

But of course if you are talking about online food delivery or online retailing, you should get your business registered for better trustworthiness.

No other permits required unless you would like to start up your own pop up or a brick-and-mortar business, then it will involve local council permit.

Good point. Was worried about food safety/handling etc that requires license. Will go to SSM to register this food startup as an entity of LLP. Adequate enough I believe?

Dafety/handling license is only required if you are involved food processing/packaging. If you are just cooking food then no license is required.
Yes a LLP is sufficient for your case.

depends on your location. if you are in kl, food is under dbkl. if you do go setup a stall, without dbkl license they can come with a lorry and take away every of yours & fine you. it is under lesen penjaja or something (street stall license).

some license can be under your name, some requires ssm (company).

if you have a shop/venue/factory to cook/produce food you need a central kitchen license. goto dbkl (or which ever your location is), talk to them. they r very nice n helpful. also always remember to take down the dbkl officer's name, department so in the event if u enter into court (or some other department guy ask) u can always say u get that info from xxx from which department.

for food venue (retail), you WILL need to get approval from several departments (dbkl will advise you), like ministry of health clearance (vaccination), bomba clearance (fire prevention) & others, plus onsite inspection from all the departments.

to those who suggest go do THEN figure out the legal aspect later... duh... always check with the local authorities first, as that is your responsibility. the court of law in malaysia => ignorance is not an excuse

i've have a couple of business (see my signature below), open a F+B outlet (cafe) before, so i went tru that process. malaysian government staff r really friendly & helpful (so long as you are nice to them), so do not hesitate to ask for their help.

Hi, I am opening a cafe at the lobby of an office building near Kl Sentral. Which license do I need other than SSM? My SSM license does state food and beverage. No cooking, only brewing tea an pre-packed foods

thats correct, cafe license says u can serve food n drinks, no cooking but can heat up food. restaurant license allow you to cook on-site.

It should be displayed at the shop, especially around the cashier area.

Hi All, hope to know, if anyone could help

My partner and i are thinking of using a shop lot to grow microgreen. We are not selling the microgreen thru the shoplot.. We distributing to buyer.

If thats the case, any lisence or permit needed.

Care to elaborate more on the "We distributing to buyer" part?

As far as I understand, you're turning the shoplot into a farm. As long as you're using it as part of your business, even though the main selling or transacting area isn't there, still need to apply for license. Unless you forever close the shutter door with no signage as if it's an empty shoplot, only open when you're transferring things in & out. If I recall correctly, even if you use a shoplot as a storeroom (for your business), still need to apply license.

We are very new rookies here,

Basically yes, a farm in a shoplot, not sure is can be treated as storeroom or warehouse as we can do it close door.
Distribute to buyer like restaurants or supermarkets.

So if we need to apply for a license/permit, which authority do we need to go through.

1. Register your company with SSM
2. Apply for business & signboard license with the local town council of the area that you want to open your restaurant at

ISO & HACCP may not be needed.
