 WhatToDo if ex-employer still not give EA form, after MSS

Hi friends,

My employer gave me MSS in 2015. So I contacted them to get the EA form in January 2016. They informed me they will release it in middle of Feb 2016. Then I contact them in middle of Feb, they said end of Feb. Then end of Feb, I escalate to their HR manager and request again over a phone conversation and also ensure email trail so that have some written response, but they said, sorry, they are having some SAP transition of their HR/finance/payroll system so they will give me the EA form by March 11th. The SAP part they only said verbally but did not put in the email response.

I thought the legal deadline for ex-employer to provide EA form is still February but I didn't pressure them because I wanted to maintain friendly relationship. So now is March 14th 2016 and I'm feeling worried. So far I have been very friendly with their HR lady because just want to settle everything nicely. But I'm worried that they have some problem. There was a big sum taken out of my MSS payment after 14 years service which was for LHDN withholding as required by LHDN. I am worried whether they paid LHDN or if something else could have happened to the money they withheld.

Anyone experience anything like this? What to watch out for? Or am I just being paranoid?

Try to give them up to 24th Mar (Thurs) then follow-up again.

Mean time, you compile your expected remuneration based on your salary slips and other benefits-in-kind that you expect to see in the EA Form. Compare versus the actual statement and question them if there is any variance.
I believe they should also be giving to u a summary of the tax deductions paid to LHDN for 2015. Can compare this versus your payslips and EA Form.

Your former company is prolly a MNC or big local comp. So likelihood of them screwing up on payroll remuneration and EA Forms should be slim. But it's good to NOT assume and be prepared.

I'm not sure if your MSS notification/statement mentioned anything in particular of exact figures being compensated to you - gross, deduction/withholdings, net amount paid. If yes, then can compare with your payslip and disclosure in EA Form.
