 Felt cheated and want to refund deposit, car park is at another block

Hi sifus, icon_question.gif hope someone can help the pity guy here.

Yesterday I went to sign my SPA, and then I just found out that my car park is in another block of the Condo!! FYI the car park in each block of the condo is not connected, thus in order to get to my car, I have to take lift from my block to my block's ground floor, and then walk to another block and take another lift again to another block's car park floor! rclxub.gif

I felt ridiculed and not disclosed to the full details, only to find out this at the last moment of SPA (it is very logical to assume that you will have your car park in the same block). I even got my house loan approved already.

I have called the developers to refund my RM10,000 deposit and they refuse to.
Is there anywhere that I could refund back my deposit? cry.gif

I also have the house loan approval, which means I have to pay another RM2,000 to cancel my house loan cry.gif

We do not assume when we buy a house. There is always the floor plan of your house and the position of the car park which should be agreed by the buyer and seller when you pay the deposit. Is there a clause when you don't get bank loan, the developer will refund part of your deposit?

Got two way you can get back your deposit...

1) Request bank to issue your bank loan not approve, then developer will refund your deposit...

2) collect few of same problem buyer, get a lawyer and issue lawyer letter to developer..

Normally first choice confirm can get back deposit, second choice need some lawyer fee and time to get back.

yes I admit this is part of my own fault for not checking properly with the developers, i've never encountered such issue before and never once i thought such ridiculous arrangement to exist. and I was only provided with the floor plan last time but not the car park position.

Yes there is a clause to refund deposit when bank rejects loan. but can this be done even though the bank loan has been approved and such docs are sent to developers from the banker already?

if the approved document sent to developer then you can't refund already...only way is second choice or discuss with developer management to switch car park.

at least u help some other people in future to take note on this
we all also assume same as u do if we buy house. common sense, if purchase block A should park at block A. how can they send u to block C?

1) btw if you sign on this few day.. kindly contact back the Bank agent.. ask the fellow to hold your document first.. dont submit first..

2) Get loan from other banker.. request them to provide rejection letter = get back refund

it's SDB, it is(was?) a reputable developer famous with its high end development, could not believe they actually do this to me.
it is a huge cost to pay for a lesson to me, hope other buyers do not be like me, has to be careful even if the developer is reputable.

Wow..SDB which project?..looks like the insanity of dev goes to the another level..

i believe many dev not really can tell you which level or lot of your parking but to say another block of residence,this really makes no sense at all.

This is really ridiculous and does not make sense at all.

How about trying to negotiate with the developer to swap a unit where the car park is in the same block?

Last resort, engage a lawyer to write in to them to demand the refund.

This is SDB style, if your unit is of lower price , the car park will be allocated further from your unit. Try nego to allocate visitor car park to you if it is nearer to your block. Once S&P signed, zero chance of swapping car park.
