1)  Yes, it is true.  Check with your accountant.  The rule is in the book.  The question is whether it is enforced or not, I have NO idea.

2) Make sure your paid up capital is less than 250K.

I tried to get the E-Pin but they said its only available April rclxub.gif

The rebate is for everything .. like the auto relief rm8k, and magazine and whatever rebate we submited. LHDN will calculate total and see we overpaid or underpaid ... and then we have to pay extra ? or maybe they pay us back ..

Do this process all happend on the spot we submit ?
*
Pin no for personal efiling is available now. Just go to the nearest LHDN branch b4 it gets too crowded as efiling BE/B2008 just started today

Just notice in e-filing have a deduction for SSPN up to 3,000.
So if have wife and 1 child, can deduct up to 3 + 1 + 3 = 7,000 every year
provided you deposit 3,000 every year into SSPN.
*
??? Each taxpayer can claim to max RM3000 for SSPN, So taxpayer can claim RM 3000 and wife also claim RM 3000 if assesment is made seperately.

Thanks for the info there.

Questions again.

1) Regarding the BE 2007, my employer did deduct on one month of my salary. That speaking, my salary does not reach RM2,500 but at a particular month, i am given an allowance claim which incidentally, made it over RM2,500. Does that mean i still need to declare my BE2007? If i have not declare yet, what shall i do at this point? Will i be fined?

Thanks..
*
You can still file for BE2007 but must be done manually. Either go to the nearest LHDN office and get a BE 2007 or else download pdf format from LHDN website and print with laser printer on A4 size paper(specs are strict). If you are taxable there may be a penalty. If you don't file then you will not be able to claim for your 2007 PCB deduction. DO NOT declare your 2007 income in the arrears section of your 2008 form.

Cheeroy, who said I was spamming. This is the fact. Please refer to Schedule 6 of the Income Tax Act 1967.

Regarding my Note No. 1 can find in Sch 6 ITA.
Note 2 : Its an income tax exemption order which is also part of the internal circulations. I dont think you will be able to find this.

You think I like to spam in here?

Only state/parlimentary allowances received by ADUN is tax exempted, other income e.g rent , partnership profits, salary from other source, spouse income is taxable.

just a question , do Bank interest consider taxable income as well ?
*
For Malaysia it is considered tax at source (final tax) so do not declare in the Form BE/B.
QUOTE(deodorant @ Mar 4 2009, 03:21 PM)
Of course I could have miscalculated (hopefully), I just did some quick 2-min calculation only. But yea my bonus was about half of my entire year's salary.

Anyway while going through my last year's submission, I suddenly realized that my deduction for life insurance and EPF contributions was left blank! omg! That means I paid too much tax, zzzz. Any idea if I can still go back to income tax office to amend last year's submission?
*
Yes you can still make an appeal. Appeal have to be made in writing together with your EA form(for the EPF) and annual life insurance statements/receipts. Your audit officer may also ask for the receipts for anything else you have claimed.

Hi...
I've a question on dividends received on shares and REITS.

Assuming that we are already in a tax bracket that is higher than the rate deducted as source. eg.

- REIT distribution has been deducted  15% at source but our tax bracket is 20%, do we need to declare the REIT dividend as taxable income?

- shares dividend has been deducted 25% at source but our tax bracket is 27%, do we still need to declared the dividend as taxable income?

Appreciate any advice on this... thanka a million
*
REIT is treated as FINAL tax therefore no need to declare as taxable income and no refunds will be paid back.

For dividends from shares either 25/26% you will have to declare it and can claim back refund if aplicable. If you are at 27% then you will have to pay the extra 2 or 1%. REmenber if did not declare and later detected at audit then penalty is at minimum 45% of tax.

Yup, I also doubt those things can be claimed but it is the adviced from tax professional invited by 988 radio to consult public.

Any tax professional here can verify this?
Thanks!

I can categorically confirm that chicken soup even though recommended by Dr cannot be claimed as medical expenses fot income tax purposes.

Haiya, only medical expenses incurred by parent as evidenced by receipt from Doctor registered with MMA will be considered. Although extension is given to nursing home/care.

How about medical bill for our baby , can we claim it ?
*
No unless baby is suffering from SERIOUS illness as per examples in guide- haert, kidney etc. Normal fever & cold - NO.

Normal baby check up, I dun think so . I don't think any hospital does 'full medical check up packages for infants'.

Oh well, it's that time of the year again when we have to file our tax returns.
This is a good thread. The broadband is something new for this year.
Want to ask, medical fee for parents can claim as relief right? Went to a private clinic, paid RM37. Can claim? The receipt is under my mother's name.

Also, I pay for my mom's medical insurance premium. Can claim this as relief as well under medical expenses for parents?
*
Q1 - Yes, If required have to show birth cert.

Q 2 = No, medical insurance = NOT medical expenses

Thanks in advance for the reply.

Rental income is income. You have to declare your net rental profit.

Deferred annuity is a type of life insurance . Ordinary life insurance in Malaysia = lump sum payment at the end of maturity.
Deferred annuity is life insurance with instalments paid over set period/life(eg monthly payment until death) at maturity. sort of a pension paid by the life insurance co.

I think some ppl may say it as saving plan. you save money until maturity, then the insurance company pay you back with the profit after maturity until death.
*
Check our policy. If you konk off before maturity what happens? If beneficiary receives assured amount then by definition its a form of life policy. If beneficiary receives nothing then obviously its not.

From wiki

A life annuity is a financial contract in the form of an insurance product according to which a seller (issuer) — typically a financial institution such as a life insurance company — makes a series of future payments to a buyer (annuitant) in exchange for the immediate payment of a lump sum (single-payment annuity) or a series of regular payments (regular-payment annuity), prior to the onset of the annuity.
The payment stream from the issuer to the annuitant has an unknown duration based principally upon the date of death of the annuitant. At this point the contract will terminate and the remainder of the fund accumulated is forfeited unless there are other annuitants or beneficiaries in the contract. Thus a life annuity is a form of longevity insurance, where the uncertainty of an individual's lifespan is transferred from the individual to the insurer, which reduces its own uncertainty by pooling many clients. Annuities can be purchased to provide an income during retirement, or originate from a structured settlement of a personal injury lawsuit.

Hows the taxation like?
