Follow up with the lawyer or land office itself.

After one month of application for consent, my lawyer told me the consent has yet to be obtained. My husband went to land office to check it out, the consent was ready for collection 3 weeks ago.

Registration of title and collection of registered title from land office - after submission for registration, the lawyer supposed to collect it within 30 days (If I am not mistaken, anyway it is written and your lawyer should know.) So, make sure your lawyer collect it within 30 days, otherwise, you have to pay penalty for late collection. And yes, I am talking about Selangor. biggrin.gif

Lawyer fees are always negotiable, even though lawyers are not supposed to give discount. As for my case, my original SPA lawyer charged less than 25% for the MOT execution.

Hi guys, lets say I managed to sell of my property before the strata title is issued (as in the developer has not notify me that the strata title is ready).. in future, when the strata is issued, do I need to pay anything since the property has long been sold to the 2nd buyer? Thank you smile.gif

Sorry if I'm kinda out of topic.

I'm currently in the midst of making a booking for a subsale. Strata tittle non bumi unit, only to realize vendor/owner do not have the strata tittle cos she nv perfect the tittle transfer even though the strata tittle was issued.

My concern now is the length of the process as I'm looking to be in that house by next year June.

it depends - if there is no hitch meaning developer is still around - then maybe can straight transfer the title to you but if developer
says must transfer to current owner then only transfer to you it may take longer..

also how long depends on whether its leasehold or freehold..

so suggest you seek advice from your lawyer as to whether how long it will take approximately..

if you are worried it is delayed past June you could ask the owner to let you have VP first and you pay a nominal sum for rent (50% of market rate) while waiting
for completion.

Thanks for the advice. It is leasehold. Developer is very much alive, Sunway Damansara Sdn Bhd. Starta issued, but owner nv do perfection. Reading a few forum and thread saying

1) Owner perform tittle perfection could take min 3-6month it self before it is transfer to me the buyer.
2) Developer direct transfer but will have somce charges, wonder who would bear the cost.

Thought bout the VP thing too. Thanks again.

8/10/2018 : Developer doesnt allow direct. So it has to go back to back transfer.. 1 after another completion. its going to be a super lengthy process.

leasehold/freehold is not the issue

whether the property has a restriction in interest / sekatan kepentingan is the proper term to use.

Thanks for the feedback guys.

For my case, Strata, Leasehold, completion date 2005, not allowed direct transfer

same time, i also found out from developer that, Bumi buying so called non bumi will be automatically bed Bumi is somehow true.

Developer says, there is no really bumi lot, rather than bumi quota, as long as a bumi buying a house, it will be considered into the bumi quota.
We wont be able to identify bumi quota unit in Strata Tittle. Have to called up developer, but as long as the tittle is bumi... you can almost 99% sure it is Bumi unit.

why 99%? becos my friend bought from a chinese bumi,sabahan, chinese name, and his unit not under bumi quota. so....
