I think MantU was asking if seller is entitled to CLAIM the DP upon the SPA was executed.

I think for secondary market, it's the contract law that binds the transaction and terms of the SPA therefore is negotiated rather than as prescribed by HDA. To this end the buyer would have insisted it's the buyer holding the DP as stakeholder insisted of seller's lawyer/seller. too bad i think the price is too irresistible till the buyer agreed to otherwise.
