Before sign SPA lawyer should check with developer about the property status n inform them prepare for consent before SPA. By this at least developer will notice something suspicious if 2 consent ask for same time

It is a standard procedure to check about caveat before SPA but lawyer must do more to protect new buyer like checking how much seller still owe bank , developer, assessment ..at least buyer won't stuck in middle in case purchase price unable to deduct all hutang

btw the buyer who paid DP vs sucessful bidder... actually if sucessful bidder lost.. bank should be able to return the 10% auction... thus losing nth.. the buyer should be allowed to proceed with d S&p via specific perfomance .. I.e if he is not signing a court order will be allow to sign...with that seems fairer..

I have seen d case.. normally bidder cari makan.. pay him some money.. should be ok.. in terms of law.. this point can be argued in court.. but d cost...
