House buyer / Purchaser
Developer
Consultant (Architect, Engineer and etc)
Main Contractor
Subcontractor / Vendor / Supplier
Local Authority (DBKL, BOMBA, SYABAS, TNB, TELEKOM, POS, JKKP, IWK and etc.)

Hi iwubpreve

I need help with latent defect report filing? what is the procedure and how do i file it against the developer. The reason is because i am witnessing defects post the DLP and the developer is ignoring it. With little research i found about the Limitation Act 1953 and i am not sure if this comes under the KPKT tribunal.

The defects are water leaking caused by rain water drain pipe which is installed inside the wall. The only way to check this is by hacking the plaster ceiling near it.
Legal action meaning that i need to hire my own lawyer ?

base on strata title acts, if the pipe is meant to serve ur unit, its ur responsibility after DLP. so this rwdp apparently is collecting rainwater and it should be a common property. management should fix this.

Thanks for the explanation. Sorry that i didnt mention earlier that my unit is double story house but under strata title. Does the same strata act applies as well and also what information should i look for in my S&P regarding these strata act
