A red proton bang me from the back this morning in Sri Petaling area.

We negotiate and I requested him to pay me RM200 but that guy keep saying he only have RM50.

I told that guy just give me whatever you have first and please pay RM150 later.

I followed up with sms later which ask that guy to paid me by end of today otherwise I shall report to police.

He was not please with my request and said that I have agreed earlier that RM50 is the settlement and went ahead to police to lodge report first.

Later police called me and told me if I want to claimed insurance and make police report, please refund the RM50 to him. Otherwise there will be complication later when police issue saman to him and claim insurance from his insured.

I tried to call that guy but he is not answering now. Is what police said correct and anything else I can do?

So, in future if I receive compensation from the driver who bang me, whether partially or full...

I am not supposed to make police report?

Because it is considered the accident already settle between ourself?

I finally able to get hold of him yesterday and already back in RM50 back to his bank account.

Now it is up to him to make police report. My workshop pic also told me it will be quite hard to claim his ncd if he don’t make police report. Police may still come out with keputusan report w/o his report but it will be worded in such a way that is not acceptable to the insurance company

if the accident is only minor damage, then it is best to settle on the spot ie ask the other party to pay the damage upfront. But there is also a risk that tre workshop may charge us more than what we ask for later.

If the damage is more serious one, then go ahead to report to police and claim insurance. I personally find that insurance claiming process is pretty lengthy and take out some of personal time. And it need both parties to make police report.

Kindly comment if I am wrong. There is pro and cons on both approaches.
