 Can gym center put your name in CTOS?, Some stupid dodgy gym

Hi /k selamat pagi

Joined gym last year around September, then i had some medical problem, had to stop until yesterday they call me threatened me to pay the 8 months balance because my name already being put into CTOS. My had because i diddnt freeze or terminate my membership plus its just some dodgy gym.

MY QUESTION IS, can they do that? I mean can they really put my name in ctos record?

Why so many people sign up for gym membership, have they never ever read any of those thread regarding gym membership. Getting in is easy , opting out is a mess.

If they have an account with CTOS, yes they can file a Trade Reference. Stating that you owe them X amount of money for X number of days.
This is what most Telco do. Especially P1.

Alternatively, they can file a lawsuit against you. Then CTOS will pick it up own its own and place into their database as ongoing legal case.
The latter will cause problems for your bank loans applications in future.

U should have contacted the gym to freeze your account in the first place. U signed a 1 year contract, and they dont know u having health problem.

Why not? If they have a monthly amount of customers to chase for slow collections, it might be worth it to them. All they need to do is pay a monthly subscription to CTOS for an account.

Show your proof of medical issue, if they still insist you need to pay, you can take this case to tribunal court.

they can but it means nothing, i mean no banker is going to look at your CTOS and go, eh he didnt pay his gym membership.

but i find something silly about this, most gyms are not that hard to get out of if you have a good reason and chances are their contracts can be bought out.

i suspect the prb is more simple, ts no go gym then cook up story say medical prb

The gym called me, threaten me to pay the balance or take their SOLUTION by paying RM1200 and free another 1 year membership.

Should I report them to tribunal ?

you being unfit has nothing to do with you signing a contract with them. whether or not you are unfit, you are still liable to pay for the membership. end of story.

the best u could do when u discover u are not fit with letter from doc

u can show them the cause letter for u to terminate the contract
immediately but you didnt

its time for you to read back your sign contract ... which you should have done before signing it

Did you inform the gym that you were unwell and had been prohibited by doctor to participate in strenuous activity the moment you found out about your condition?

If so, on what grounds did they rejected your request? As far as I know, most gyms would allow a temporary freeze on membership for certain unforeseen circumstances.

If you just decided to stop going, then suddenly am surprised they are charging you for it, it is entirely your fault.

How do they threaten you ? By merely asking you to pay up what you owed them doesn't falls into 'threaten' part. They also offer you an alternative.

Sue them? Don't think so..TS bound to lose the case.
He signed contract (not got anot, he never said got, but on basis he signed a contract) but disappear without paying membership. He SHOULD have inform them in the first place. Not playing MIA then get hit with the consequences only cry this and that.

This should be common sense..inform when not able to do something. Unless he mentally retarded or a 3years old.

Yes they can put you into Trade Reference in CTOS for that amount. I kena before for rm1600, but I agreed to settle before they took legal action. The company was listed in my CTOS Trade Reference list for a year and was removed after I settled the amount.

I did ask around before, you don't want to mess around. Just pay up what you owed, because you signed the contract means you agreed to their term & conditions.

TS problem. Unlike P1 where they couldn't provide service (no connection or there is connection but you can do jack with it) and you terminate in writing, etc, then when P1 want to CTOS you, you complain like I did and after 9 months with CFM, P1 and finally Consumer Tribunal with all my emails to them, finally total waiver when CFM wrote that it was unfair practice.

No such thing as freeze acc or terminate, see many people reply here no experience with gym membership contract, no matter what you still have to honor that 1 year period, even you dont come still need to pay, that why famous gym now ask for your cc to monthly deduct

They also got clause if you not inform them you want to quite 1 month before the contract will be auto renew, once they caught you hard to escape

Yes. CTOS is a privately owned company and the listing is not regulated, anyone who pays to have access to the CTOS registry can put anyone's name in it.

However, blackmailing to put your name in CTOS, is not permissible by law.
