Date of transaction: 5th March 2014
Details of the complaint :
5th March
Noon : Contacted seller, requested that if seller can send out on same day I will confirm the deal. Seller agreed and I made the transfer almost immediately.
Evening : Contacted seller for poslaju tracking number, unfortunately seller advised he passed to his colleague to send, will update later.
Late Evening : Contacted seller again, but seller said his colleague too busy to send out. Seller promised to deliver next day personally. Disappointed as I am not in Malaysia and only back this weekend, needed the phone to arrive latest by Friday. Had no choice but to accept the situation as it is.
6th March
Morning : Contacted seller again to remind him to poslaju it asap.
Noon : Contacted seller again for the status, replied said having lunch and will post later
Late Afternoon : Contacted seller again for the poslaju tracking number, and responded almost immediately with the tracking number.
7th March
Morning : Checked on poslaju system... no such tracking number (didn't hope our system to be that efficient anyway)
Noon : Waited... nothing
Late Afternoon : Waited... nothing
Evening : Confirm didnt arrive by Friday...
8th March
Morning : I called 1300-300-300 (Poslaju hotline) and confirm no such tracking number on their system.
Morning : I called seller, sms seller, whatsapp seller but all no response. Requested for tracking slip picture as proof but no reply.
Afternoon : I sms seller requesting for full refund, no response.
9th March
Late Morning : I called seller, told him about the situation and he agreed to refund me back the money.
Late Morning : I sms'ed my bank account detail and requested his mailing address. No response after that.
10th March
Morning : Back in Singapore, I tried my luck tracking the poslaju number, but on the system still invalid.
Morning : Sent another sms reminder to seller to refund me the money and also requesting for his mailing address. No reply.
Afternoon : Called seller from Singapore, answered my call but insisted that I should return back the parcel 1st before he do a full refund. Does not make sense if he failed to deliver upon agreement and yet wants me to deliver the parcel to him 1st ? According to seller, if parcel is deemed lost, it is not his responsibility.
Afternoon : Called Poslaju and still tracking number is invalid. Check online and still invalid. Parcel have not arrived.
Evening : Confirm didnt arrive on Monday...
Evening : PM'ed seller to proof himself with the poslaju slip and to advise when to refund me back. Else will instruct my brother to make a police report on my behalf.
11 March
Morning : Something weird is about to happen... I guess seller is trying to send me an empty box with a proof of the delivery slip ? From poslaju link, apparently it was only delivered yesterday after I threaten for full refund and police report. Will get my bro to do a video while opening the box to ensure I did not cheat anyone. Noon : Package arrived... video taken while opening the parcel and confirm it's Samsung S3. However, very disappointed with the content. Look at the pictures attached starting with the poor packaging :

Afternoon : Seller's account given dispute tag

Apparently the seller have already not logon since 13 March and I fear he may have created a new account in LYN. Also, thank you to bro Gurvin Abruzzi for your offer but the Samsung S3 have already been sold as is condition without any lies. I will continue to bump this thread so that this serves as a reminder to anyone in future dealing with any seller by the name of "Heng Kok Hong".

To Heng Kok Hong,
I still expect a full refund of RM500 and I will get my brother to poslaju back the item in a way better packaging than yours.
You have violated 3 rules of a sales :
1) You did not deliver as promised
2) The product you described was not as you mentioned
3) You failed in your communication with the buyer
Therefore, please refund me back by today or I will raise a police report or tribunal report against you. Also I will work with Lowyat to ensure you get a dispute tag on your account here so that you need not do any sales here anymore !

I will be making a police report against you. I have lost all confidence in our deal, whether the parcel arrives or not, whether you will full refund me my RM500 it doesn't matter anymore.
I will be taking legal action against you even if from Singapore.

The reason why I need the phone urgently by Friday is because I am working in Singapore and I'm only back once a month. So why did you agree that you could deliver the same day as negotiated ? So what's the point of the phone to arrive maybe next week (if you are legit) and I am back in Singapore ? Right now, I want a refund and I will get my brother to poslaju it back to you without opening the package. Very disappointed with this deal as I intended to pass this phone to my partner's sister when I go back to Singapore this Sunday...
If you did send out, please whatsapp me the slip as proof. I am sorry if I may have defamed you for something you didnt do any wrong, but your response have been very poor. You have seen my whatsapp msg, but didnt reply.
