Rodgers: Suarez is in great spirits

Brendan Rodgers remains relaxed about Luis Suarez's future after the striker joined Liverpool's tour squad in Australia in 'great spirits'.

Suarez missed the start of the club's summer tour after being given time off to recover from the Confederations Cup, but he met with his teammates last night and is expected to feature against Melbourne Victory on Wednesday.

At a press conference to mark Liverpool's first ever visit to Australia, Rodgers was asked whether he had spoken to the Uruguay international about his future.

He answered: "As we've always been as a club, I'm quite relaxed about it. He's an integral part of our squad.

"We'll chat at some stage, like I do with all the players.

"But he's back, he's in great spirits. He's obviously an integral part of the group - you could see his closeness with his teammates last night when they were all seeing him for the first time in a number of weeks.

"He'll join training today with all the other players and over the course of the next few weeks we'll communicate.

"Him and I have been in regular communication throughout the summer."

Rodgers was pressed further of whether he expected Suarez to remain at Liverpool for the 2013-14 season.

"Yes, very much so," said the boss.

"There's been a lot of speculation over the course of the close season but the reality is that he's a player who is very much valued at Liverpool and unless there's any sort of offer that comes in that's anywhere near his value, there's nothing to consider.

"We haven't had that."

Asked what that value was, Rodgers replied: "I didn't say we would sell him! I said that every player has a value and a worth. Doesn't mean you've got to sell them."

Rodgers also revealed that Suarez would play some part in Wednesday's game at the MCG.

"They will all be involved, they will all have some part to play," said the manager.

Arsenal have failed in their latest attempt to sign Luis Suárez despite making an extraordinary offer of £40,000,001 that they had hoped would force Liverpool to sell the Uruguay forward.

The eye-catching figure was formulated by Suárez’s agent, Pere Guardiola, who believed that Liverpool would have to allow his client to leave in the event of any interested party offering in excess of £40 million.

Liverpool have always held a different interpretation of the relevant clause in the former Ajax player’s contract, however, insisting that they need only to consider such a offer, and their conviction that is the case resulted in a swift rejection of Arsenal’s latest bid.

Liverpool officials were bemused by the nature of Arsenal’s latest attempt to acquire Suárez, particularly after Ian Ayre, the Anfield club’s managing director, informed Ivan Gazidis, the Arsenal chief executive, over a fortnight ago that £40 million would not be enough to buy the 26-year-old regardless of whatever encouragement Guardiola was offering them.

That came in the immediate aftermath of Arsenal’s initial £30 million offer, which they claimed would be their first and only bid. Arsène Wenger’s growing belief that Suárez is willing to join Arsenal, however, encouraged the North London club to submit an improved offer. After Liverpool also gave that proposal short shrift, they will have to decide whether or not to continue their pursuit.

In keeping with their own analysis of Suárez’s contract, Liverpool will inform the player of Arsenal’s latest offer after their pre-season friendly against Melbourne Victory today.

That's subject to interpretation of the contract.

Liverpool admitted for the first time they will sell Luis Suarez, after the player told them he wants to talk to Arsenal.

However, Anfield boss Brendan Rodgers has put a £50million price on the head of his Uruguay striker.

Arsenal triggered a clause in Suarez’s contract with a stunning £40,000,0001 bid this week, although Liverpool rejected the offer and their American owner John W Henry tweeted: ‘I don’t know what they are smoking at the Emirates.’

But the first signs Arsenal’s strategy is working came when Suarez was told he can to speak to the Gunners as Liverpool finally admitted they are prepared to sell him.

Arsenal are ready to raise their bid slightly plus add-ons and bonuses but they are unlikely to go to £50m.

Suarez played in Liverpool’s pre-season friendly in Australia yesterday, but showed no emotion as he was congratulated after setting up Liverpool’s second goal.

The decisive factor will be Suarez’s next move - and he meets Liverpool manager Brendan Rodgers today Down Under.

Liverpool are adamant the £40m clause does not mean they have to sell but Suarez’s camp see it as a get-out.

Arsenal’s biggest concern is Real Madrid making a late bid, and they are set to receive a £30million boost to their transfer kitty after agreeing to sell Gonzalo Higuain to Napoli for £30m.

Arsenal will put a five year, £150,000-a-week contract on the table to tempt Suarez.

Liverpool confidence over Luis Suárez's contract hints at confusion from Uruguayan's advisers

Liverpool seem very confident about the £40 million-plus-one clause in Luis Suárez’s contract, and it is entirely possible that the striker, or those advising him, have misunderstood the technical terms of the agreement and/or their effect.

Normally, a player at one English club cannot speak to another without written consent until after the third Saturday in May in the last year of his playing contract.

But players are able to negotiate all sorts of clauses into a contract, from straight release clauses to those which allow them to speak to other clubs earlier.

So Liverpool could have written into the contract that if an offer comes in over £40 million, then Suárez has the right to talk to the club involved, in this case Arsenal.

That would allow Arsenal to determine whether he actually wants to join them and whether they are able to agree personal terms.

But that does not mean that Liverpool will agree or be obliged to actually transfer him or terminate his playing contract early.

What Suárez and his agent may have done is got confused between the Spanish system and the English system.

If Suárez had been playing for, say, Atlético Madrid and he wanted a release from his contract (as is normal in Spain), he would have written in that he has the right to buy himself out for say £40 million. The buying club then pays him to do that and the payment is effectively redirected to Atlético. In England, transfer fees are paid directly between clubs.

It is possible that Liverpool were very specific with Suárez and his representatives when they agreed his most recent contract.

A lot of it is to do with the drafting, which has to be very precise. For example, you could try to write into your contract that it would be foreshortened by, say, two years in the event that your club does not qualify for Champions League football.

However, clubs do not like the idea of players become free agents at the end of a particular season, so they could try to make the release clause conditional on a transfer bid coming in on specific terms above a certain amount.

This is where the drafting becomes quite complicated and you need to be careful about how it is constructed. Release clauses were pretty unusual in English football 10 or more years ago.

If you go back pre-2004, the Premier League money was less. As the amount of on- and off-the-pitch income has gone up, and as clubs’ desire to employ a player at the peak of his form has increased, release clauses haver become more and more common. I have seen it quite a lot over the last few years but I tend to deal with particularly high-value players.

Footballers’ contracts do not have too many odd clauses – unlike those in the music business. What you sometimes get are football versions of moral turpitude clauses, especially where the player might have a particular history.

Occasionally, there are provisions for houses, for payment of rent for an extended period, signing-on fees, and customised loyalty bonuses.

There are also now image-rights structures, how they blend in, how you apportion image rights between the club and player. But nothing particularly fancy.

Brendan Rodgers has urged Luis Suárez to repay the loyalty that Liverpool demonstrated throughout his racism and biting controversies as they prepare for a protracted dispute, potentially a legal one, with Arsenal over the striker's contract.

Suárez and his agent, Pere Guardiola, believe talks should commence on a prospective move to Arsenal now that Liverpool have received an offer of more than £40m – albeit by one pound – for the Uruguay international. Liverpool maintain that a clause in the contract Suárez signed last August obliges them only to consider a bid in excess of £40m and inform the player of developments. The striker is valued at more than £55m by the Anfield club and Real Madrid, set to bank £34.5m from the sale of Gonzalo Higuaín to Napoli, may yet formalise their interest in Liverpool's prized asset.

John W Henry, Liverpool's principal owner, underlined his club's view that Arsenal did not trigger a release clause in Suárez's contract with Tuesday's offer of £40,000,001 when he mocked the bid on Twitter. "What do you think they're smoking over there at Emirates?" he posted.

Mockery aside, Liverpool are angered it took Arsenal two weeks to improve their initial offer of £30m plus £5m in add-ons, and only then to a sum that the chief executive, Ivan Gazidis, had been told would be instantly rejected. For their part Arsenal, evidently encouraged to believe that £40,000,001 would prompt negotiations with Suárez, hope the 26-year-old will agitate for an exit from Anfield in the coming days. A Premier League or legal hearing could ultimately be required to resolve the stand-off should it continue.

Daniel Geey, a football lawyer at Field Fisher Waterhouse, said: "Premier League regulatory commissions have previously been tasked to look at such cases, as Liverpool know from the Christian Ziege ruling in 2002. The difficulty in the Luis Suárez case is that, even if it went as far as a regulatory commission or to court, and the judge made it clear what the clause says, that is not going to happen before this transfer window closes and perhaps not even before the January transfer window closes.

"Presumably Arsenal are not supposed to know about any confidential clauses in Suárez's contract. That was the problem for Liverpool in the Ziege case when they were fined for making an illegal approach after they were informed of a £5.5m release clause in Ziege's [Middlesbrough] contract. The commercial reality is that Luis Suárez may have to force Liverpool's hand or Arsenal will raise their offer. Liverpool are not going to force the issue in relation to a provision which they believe does not allow Suárez to speak to prospective suitors."

Rodgers was due to hold further talks with Suárez, and inform him of Arsenal's rejected second approach, after Liverpool's pre-season friendly over Melbourne Victory on Wednesday. The striker received a rousing reception from a remarkable crowd of 95,446 at the Melbourne Cricket Ground, where he appeared as a 72nd-minute substitute and created a late goal for Iago Aspas in Liverpool's 2-0 win.
