I js get caught of car accident last friday, made a polis report after 2 hrs.

Called up the polis today and yet been informed that opponent made a polis report as well but havent yet meet him up for investigation, yet am advice to wait till 8th of June this week.

What should I do, and what's the normal procedure to handle it?

Come come, everyone please come in advice and share your experience.

i also meet accident. i want go report after 24 hours. the police say need saman RM300. but he ask me check that people got report or not. after check that people no do report then the police say dont need report. if want then need pay RM300. so should i report or what

Are you in the wrong? If you are in the wrong, then yes, you need to pay the RM 300.

By now the Polis and me both think that opponent fault, but it is depends on my photo that I captured and my descriptive of the accident scene. Thats why the polis asked me to wait till opponent give her descriptive of accident only can conclude about it. :/ thn right now am being ask to wait till 8th of June due that the opponent get some issue at Johor which he isnt free to meet the polis.


If not mistaken, yes, any accident need to be report within 24hours... but about the Saman part is like.

Report polis if u wan to claim from insurance. Otherwise waste time and saman.

Exactly, my situation is I try to discuss with the opponent since damage is so minimal, she dont admit her fault plus insist and ask to report polis.

Uhmmm if it is ur fault, no good to make report, but if opponent made one thn thus you got no choice.

You situation should be a no report required as opponent neither make one, as if you wanna claim his insurance you should do the report after ur accident or within 24 hrs.

i thinking, will after 1 week he go and make police report or not. since he have taken accident photo. And i have repaint my car too.

I have the same case. It was my fault and went to make report. Police told me wait till the other make report. So next day i check and wait for him to make the move but no report.

Today, after 2 weeks, i get letter to meetup regarding this. Can the guy report after 1 week?

Yea it states that I need to report in for investigation. But clearly he did not report in the 24hour mark.

Uhmmm, better to stay safe, even before you repaint your car, keep all evidence records you have. We need someone expert to be here and advice also.

nor even 24 hrs, how it is applicable for a week? But to be on safe side, the best solution I can think now is kept all evidence records down, date etc. My fren told me if u spot those car passed by u on the accident scene, you can note down their car plate no. as eye-ing evidence. uhmmm

Then you go make a new polis report that you kena hit and run. Now request pampasan from them.

if is our wrong, i dont think can use hit and run. but i think if not within 24 hours should be cant claim right? cos all the evidence may not be true.

Just forget about it. Since you already made a polis report just to safe guard yourself.

Just help a friend that involve in a minor accident recently. A lady bang from behind, only damage the bumper. She doesnt want to pay so we have to report police to claim insurance. We got the lady car plate number, ic and drive license.
When to police station to report, fill in the report: date, time, location, car plate, model, color...
Chit chat with the police: since bang from behind, sure that lady's fault = 1 saman. But if she didn't report in 24hr, another saman and reminder call and letter from polis. If still don't report, blacklist in JPJ for both car plate and driving license. But that will mean my friend will have to claim own insurance already since the lady didn't report. At the end the lady did report but is after 2 days, she called my friend to change date of report, well fxxx her also no time.

No, all accident should report to police unless settle privately. If you don't make police report, the insurance might not cover your side if something happen.
Probably, "po****" want to save work from summon the car owner to investigate.

Since you have done the police report and you've been told to wait, then you wait. Nothing you can do. Wait for the Sarjan to call you and he will inform you if you are the one to receive the saman. Go meet the Sarjan to settle the saman. Don't ask him to send to you. Everything will be ok, relax.

my friend also kena saman if she report. she not in the wrong just the police say if you report after 24 hours you are late and need to pay saman.

because that day that person didnt take my name ic all those. just take photo of car. then say want report police. after 24 hours i want go make report the police but the report say want saman me 300 for late report. i ask him how he say check database first. then database didnt show he report i bang him so police say can dont report. if want report also can but need pay 300

i crashed my car to a tree on my own and I reported to police to claim my insurance. Now the car is still being fixed.

the 1st summon is late report, the 2nd summon will be u found guilty for bang people (after investigation, in case you bang people).

You should report it (in case you bang people, no matter how, unless you already pay cash) so that poeple can claim from your insurance.

There is the uncertainty. He may or may not report.
It is up to you which choice you want to take:
a. Don't report, pray hard the other party won't report for hit-n-run.
b. Report with saying that forgot who has you bang -> pay for late report summon. Police can't investigate unless the other party report.
c. Report with car plate -> pay for late report summon. Police will summon the other party for investigation. ! more summon to you if you find guilty.

What is the other party damage and how many days already? If damn minor one, why don't settle on the spot?

the report will only cost u RM 4.00 if u want a copy of report

Yes, I make a report without paying a sen. It means if you required to get report of the opponent, you need to pay RM 4 for the printing fee. haha

Guilty party will be saman for RM 300.

the police say u can report at any police station, but after that u need go the traffic station for take photo of the car damage

Hello....i just met with some minor accident today that bang from the back when the other party come out from a stop line road.

She agree to pay me but the weird thing is, she want to pay me after 24 hour (via bank in). What should i do now?

Wait till she bank in to me on the time agreed, or just went to make a police report to protect myself first?

Anyway, can i call to police station and ask whether the other party has report?

I just worry that after 24 hour, i will be summons for rm300 due to late report.

Ask her to pay now or you just go ahead and make report. You are allow to make report within 24hours started on the time where your accident occurred. See her game play?

Hi all, need your advice if the opponent / guilty party did not report, how can i claim his insurance?
I have reported within 24 hours and now has been more than 2 weeks, the opponent party did not show up even the sergeant has sent him letter. I asked the sergeant what is the next action, he said he will only blacklist him but cannot issue any summon to him. Is this the correct procedure?

Based on my last conversion with a sergant, u make the report in 24 hours would be right. Have you get his car plate no. and IC? The blacklist and cannot issue any summon doesnt sound right to me. I think within a period if the person doesnt show up, sergant still issue summon one... uhmmm....

Ya i have provided his car plate no. in the report. But they dont want me to provide his IC. Even sergeant said dont need it. That's why i think the sergeant waiting for me to ask for "favor". He said he is not supposed to summon without the person showing up.
Also, i have checked the opponent party Ic from myeg, there are 20+ summons not clear since 2008 for another 4 plate numbers. What's the point of blacklist then?

Poor u, thn this is seriously a very bad case... no fren in law field, maybe can ask about their opinion, or consult ur car insurance agent, they would know the lubang to handle.

1. If accident take place in Kajang, can make police report at Cheras ?
2. If the opponent not willing to share their IC number and insist don't want report or pay,
, still possible make police report with their car plate number ?

Yes to both

1. Kajang belongs to Selangor state, Cheras belongs to Kuala Lumpur. Based on my understanding, if accident happen to Selangor side, shall report to Selangor Police traffic department. Same for Kuala Lumpur one. Kuala Lumpur dont handle Selangor case. Need someone to double confirm on this.

2. Do you take down evidence? E.g. photo of incident happen, their car plate number and ur car plate number... video or picture of how the incident happen... bang which side of ur car, thn where does the opponent car came from and bang into ur car etc. Yes, report police is a must but clear explanation of how the accident happen, and picture of the scene plus car number that bang u would be required to proof and able for the police officer to assist u up...

Cheras does not belong to KL entirely. Certain parts of Cheras are under the state of Selangor

I got in a self accident ytd night. Road was slippery, when I turned, the car skid and I hit the curb.

Police report, the guy threaten me with kecuaian, 4k min fine etc, so in the end I paid 300 "saman"

Did I do it wrong? Should I just ask him to do it straight and do whatever he want to do?

You hit the curb but why you got summon? As I know if we got accident without 3rd party losses we wont get a summons..

Hi guys I got front ended with damage to my car n not much visible damage to the other person car. The guy admit fault on site but he has yet to make police report. Can I send my car to fix n claim from the other party or better to wait for the police decision before sending my car to be fixed?

I am first time experiencing this situation, I didn't make the report, since there's no report at 24 hours. But now after 2 weeks, I received a letter from Ketua Bahagian Siasatan dan Penguatkuasaan Trafik inviting me to Balai Polis Trafik asking for investigation purpose, would he ask me a question or whatsoever?

Sorry for resurrecting a 4 years old thread, but didn't wanna start a new one. So long story short,
Got into an accident, obviously the other party is wrong coz it was a one way street and he straightaway banged into me. We agreed to make a police report to claim insurance so we went and did the reports. But after that, I changed my mind and asked him to just pay me straight the costs because going thru insurance will need a few months. I couldn't be car-less for too long. He said ok. Now fast forward a few months after that, I am still waiting for the payment from him. Everytime he will give excuses. My car is repaired already by my own expense. So my question is, once "keputusan kes" is out by the police, can I still claim anything from his insurance although I have repaired everything?

Insurance claim subject to adjuster to see the car before the repair and estimate the repair cost. Later insurance need to approve the claims done by panel workshop.

So the answer should be a no for your case, since you have already did the repair works.

i know someone caused hairline scratch... a bit hard to polisjh away... reported so he can claim, let workshop fixed his 1 month old new car...
