 My Maid Is Terminating Her Contract Ahead of Time, What should I do? Please help!

Hi there,

I am in a serious dilemma as my maid is terminating her contact and I am clueless of the next course of action. I was hoping some of you with good knowledge on foreign maid governance can shed some lights on my problem.

a. My maid has decided to quit after working for 11 months even though she has a 2 years contract with us. Is there anything I can do to salvage the huge sum of money paid to the agency or the maid as conpensation due to a breached of contract by the maid?

b. My agency is assisting me on work permit termination and I was wondering whether she is to be sent to the agency or still stay under my roof during this period? Since she is no longer under my employment, I have concern about the safety of my family members. Does the agency has the obligation to take them in or does the obligation lies with the employer?

irreconcilable differences? and can you tell us why would you be worried that your family members be harmed by a harmless ex-maid?

Hi Mr. Rahman,

Thank you for replying in the first place. They have asked me to grant the maid wish and terminate her work permit. They are willing to help me in terminating the work permit which will takes a period of 4 working days. During the process, the agency refused to take the maid and asked us to take care of her instead which does not make sense to me since she is the one who requested to leave immediately.

They also told me as there will be no compensation since the 6 mths probation period is over. What do you think?

Do you own any policy or any agreement? Maybe you should look through it.

I am very new to maid hiring business and I don't think I was given any contract. Is there anything else i can do beside this?

don't based on what they "tell" you, can you refer the letter/doc?

if you can't demand the repay from agent, the only option left is the subject, the maid.

Dear TS. To give you quick answers:

a. There is nothing that u can do as the replacement period is only 6-mths. Some agencies give a 1-year replacement but u have to pay some additional fees.

U can ask for a discount if u want to go back to the same Agency for your new maid.

b. By right, the agency should take the maid away. It all boils down to fees right, you have to pay the Agency some fees to take your Maid away. Say RM200 to RM300 should cover it.

What is the reason that the Maid does not want to work for u any longer? Where is your Maid from?

the maid's pay... dont give her... tell her,u want the money,u finish the contract...

if she wanna run off herself,terminate the work permit...let her be illegal immigrant...keep the passport...

Why not you terminate the working permit yourself? It will take few hours only if you go Putrajaya immigration office. Then book tomorrow's flight and let the maid fly.
Her 11 months less 6 months initial borrowing means you got around 5 months pay left.

Deduct levy and ticket flight also not much left. Give your maid some pocket money and just let her fly back.
By the way, please hold onto her passport throughout the check-in process. Give the letter of termination to the police bantuan at the departure terminal together with your maid passport. They will know what to do.

By the way, mind sharing your maid country of origin? We have enough troubles with maid from Cambodia. Under-age (Passport wrote 22 years old but she's only 16 years old). doh.gif

Be like me, maid didn't want to work after a few months, always quarrel with my wife. So no choice but to send her back....but instead, I 'sold' her to a 'businessman' who really took care of her..haha...ok, I did lose about a grand from all this, but no more headaches. But since the maid is under my name and someone else 'keeping' her, had to make agreement with them (yeah I know it won't be valid).
Good news is during the term nothing happened, and the businessman even extended her contact, but of course I renew her under that guys name.
I didn't do this myself, got help from agent (yeah, blood sucker guys). Lucky the businessman paid for most of it.
So what happen to the maid now? Who cares!

Anyway, just giving you options.
