 Form BE (with tax receipt) or Form EA, different?

hi everyone, wish can help let me know what differens between Form BE and Form EA?

how can i get a copy of that document ? i need to do e-filing?

Form BE once fully submitted to LHDN, then when can get tax receipt?

or if you have the forum link that i can go to?

can someone file their 2011 wages income tax and used the form BE submit to LHDN? what happens when you submit form BE to lhdn? they will need you to pay the income tax immediately after assessment?

I will try to answer

EA Form is given by Company; hence anyone can actually fake an EA Form

Form BE is your tax Submission to IRB. If you do E-Filing:

Once you register for E-Filing, you will be given a password / username.

Once u login, the on-line BE Form is ready for you to fill in and make amendments, etc.

(a) once the Form has been submitted, you will be given a confirmed BE Form that certain Banks, Immigration will require as solid proof of Income

(b) I believe that there will also be a 'confirmation' from IRB on your actual Income, Tax to be paid and Final Tax payable / refundable. This Info is the same as your confirmed BE Form but in a summarised One Pager. Some ppl call this 'E-Filling Confirmation'. Banks, Immigration also accepts this 'E-Filing Confirmation' as proof of Income.

why would someone fake an EA form?

i thought banks only accept fully submitted Borang BE ?

can someone submit Borang BE with high "fake" declared income ? will the Gov aware of this , or Gov will be happier because that individual pay higher taxes??

Say you want to apply for a bank loan, but your salary is not high enough to support the monthly repayment. Your real salary is RM1000, but you tell the bank it is RM3000. You make a fake EA form as proof that your salary is really RM3000.

Or your monthly incomey is really about RM4000, but nearly all of it is commission, and hence "uncertain". You fake it to convince the bank that RM4000 is your basic salary, so that they will give you a loan.

Don't know of any banks that will take an EA form. Usually, it is in addition to other documentation.

Banks usually asked for for J. Don't know about the e-filing now, if they still give you form J.

The government is large and has many parts.

Income tax will be happy that you're paying more tax than you need to.

Those department working on fraud and commercial crime, not so much. smile.gif

If you apple for Credit Cards and Personal Loans, Banks will take your EA Form as good enough. However, some Banks ask for your EPF Statement to verify your monthly income

For Housing Loans, most Banks do ask for the BE Form.

The Form J is when u do Manual Filing, believe for E-Filing, its the 'E-Filing Confirmation' that I was talking about.

If employee falsely declare higher income on his EA Form without employer's notice, will Gov / banks take legal action against that Employer?

The EA form is issued by the Employer and it represents the salaries, commission, etc that the Company paid to you.

Hence, your question:

"if employee falsely declare higher income on his EA Form without employer's notice, will Gov / banks take legal action against that Employer?"

The Answer would be NO as it means that you have faked a EA Form and it is not the real EA Form issued by the Company..

Let me rephrase blakedexter47's question.

If you are the employer, and your employee asks you to create a second fake EA form, because he wants to get a bank loan, will Gov / banks take legal action against you as the Employer?

Don't know. Probably not. Who's going to check? But if your employee is unable to repay the loan, the bank might come after you for colluding with the employee to defraud the bank into giving the loan he could not afford to repay. Wouldn't that be fun? smile.gif
