 iPhone 5 with scuffgate, iPhone 5 preorder from digi online store

I receive my iPhone 5 black 32GB from Gdex which order from digi online store. Noted got one tiny scuff at left edge. Bring to digi center for claim. However, they can claim a new iPhone 5 unit for me.
Then i requesting new set, so the staff there help me report it to digi HQ.
Today i receive call from digi center, the in charge staff told me, they have reply and only can exchange for replacement unit and have the set there if i want to exchange.
She say the replacement unit she can not confirm is new or refurbished, just know is from apple and apple told them is brand new iPhone.
Is that a way to complaint so i can get a 100% new set?
Anyone face this issue?
Or should i go for the replacement unit?
Or just keep my current phone?

if you proceed with replacement it wont guarantee you get a brand new or perhaps refurbished. plus it is way too small to notice.

My iPhone 5 was preorder from digi online store.
Gdex need you to open for item check however Gdex mention condition inside the box not thier responsible,need go digi center.
Unless item not complete Gdex will take back.
Dun have chance to open at digi center.
Thats the problem.

True also, should force Gdex take back in first place.
This what i heard,mostly nowaday all replacement unit is replacement unit, as new component also not always last long.
