in this situation, i have to say that mfg1 will lose the case and babygirl0924 will win....

why??
well first of all mfg1 you have already accepted the fault in the phone and and babygirl acknowledgin the fault and have made a rebate of RM40 in which mfg1 have agreed upon. this is as simple as it goes....

few tips to learn and you have to pay for this kind of advice....
1. goods checked...
2. no problem...
3. a week or so found fault
4. tell the seller
5. 2 things you can do
5a. return back the good and money refund (this will depend very largely on the goods and very slim chance you are able to get this since it is 2nd hand goods you are dealing with)
or
5b. ask for rebate which is more like ganti rugi, in which you have done so...

and thats the end....

also... you have sent it in for repair.... they repair it didnt they?? so why is the problem still there?? if you sent it for repair and its not, you go back to the repairman to demand it to be repaired.... without charge.... unless it is different problem from the first problem in which it is sent in for repair.

now 2nd hand goods has no warranty watsoever unless given....

so nothing you can do right now, mfg1... you just got to live with it now... this is all part of life.... and stop saying bad things bout babygirl0924

i am not siding on anyone... i read whatever is here and tell you what will be the outcome.... if mfg1 were to sue babygirl0924
