if its buying gems in RMAH right after 1.08 patch then reselling it in GAH when the price was inflated (100-200m) ... sorry to say that most cases hv been perma-ban if the gem purchased was > 100 units @ sales was > 100B.
i know some players who bought/sold for smaller amounts & their account was only suspended then after suspension was lifted, all their gears (including in stash/mules) become BoA.

i also hv no idea why ppl bother to post in this game's forum when they're not playing it anymore .. lolz
