 Vantage Point Condo Desa Petaling, 15 years after CF, still NO STRATA TITLE

I hope someone can give some ideas on how to resolve this issue.

The condo area including common area sits in two parcel of land (two master title); one is freehold and the other one is leasehold. This is one major information about the condo that most buyers were not aware of when the condo was launched in 1995, and this has led to a deadlock for the developer to obtain the strata title.

The dilemma is, in order for the developer to apply for strata title for the condo, both lands need to be amalgated to become under one new master title. The issue is that the lands have two different status, one is freehold and the other one is leasehold. The leasehold land needs to be converted to a freehold land before amalgation of both lands can be done. There is a premium to be paid to the Land Office for status conversion but the developer refuses to pay the premium. And no owner in his right mind would want to have the freehold land converted to a leasehold land.

So, the owners are in a jam. It looks like a stalemate since the developer is saying they can't do anything to resolve this issue and the Land Office can not waive the conversion premium. We can only hold on to the SPA clause where the developer is responsibled to issue individual strate titles to the owners, but the developer is not binded as to when they should issue the titles to the owners.

The residents are planning to sue the developer over this matter, but I doubt the case will be heard in court in the very near future. It could drag until the cows come home.

Is it time to call on the media's attention? I'm comtemplating of calling Puspa of TV3 to report to the public of our dilemma over the strata title.

seriously, if it's in deadlock, converting from freehold to leasehold could be a solution. It's not that bad as most of the condo there are on leasehold as well if I recall correctly.

yes, that's the solution. but the developer does not want to fork out RM400k++ premium for the conversion!

true, we know that. but there's nothing in the SPA clause that they must get the strata title within a stipulated time. it could be 100 years from now! cry.gif

subsale can still be done. but bumi lots can't be sold to non-bumis, the developer will not give consent. the developer already met the bumi quota when they sold the unit, in order to meet pejabat tanah requirement for the application of the strata title.

if title is available, subsale from bumilot to nobumi can be done, through appeals to pejabat tanah wilayah.

moreover future transfer of ownership to kids will be difficult without strata titles.

they developer has proposed a solution to the authorities; that two separate titles are issued by pejabat tanah wilayah. the freehold part on which the condos are built, will have the normal strata title, and the leasehold part on which condo facilities are built, will have a separate title with ownership under JMB (joint committee management).

the authorities have not come back to the developer on the proposal.

I already sold my unit. So the title issue is no longer my concern.

We got CF in 1997. Now it is 2015. It's been 18 years and yet there's no title. Probably Vantage Point is one of the condos in KL that hasn't got a title the longest.

"not a good developer" is an understatement for Mahajaya. I would rather label Mahajaya as a nontrustworthy developer.

do you know that Mahajaya "promised" to build a flyover from south (toll sg besi hiway) towards desa petaling? they claimed that the owner of one piece of land that was needed to build the flyover refused to let go off the land. last time from south I had to exit jln kuchai lama and made a U-turn along jln kuchai lama and turn back towards desa petaling. buang masa and petrol only!

they only built the flyover exit from desa petaling towards the city.

Yeah, owners got the title already? It's been 20 years from CF date.
