i've read some article saying that if the project cancelled, mayland have to return the deposit + penalty. they may ended up paying us double from our initial downpayment. they should be responsible as the are aware of the approval and regulation. even if they do not pay the penalty, i think we can demand them to pay whatever losses.

i just send an email to mayland to ask about the project status again. if no feedback, i think i will oficially lodge a complaint.

I'm thinking to wait until August and make decision.

I hope you can update us when there is anything new. Thank you! smile.gif

guys, any update? i've sent an email to Cheah, their person in charge, but no update.
was thinking of going to their office and getting their explaination. no update at all from news/blog/forum?
*
I called the salesperson 2 weeks ago and he said still no update from the board, and need to wait for probably another 2 months time to get updated.

He said I can emailed him if I want to cancel the purchase. According to him about half of buyers have already cancelled.

Not much help but I thought it would be nice to share anyway.

I am looking to cancel my purchase, in a way that I can get back my legal fee. I think the content of my letter will be important.

Its been more than 60 days since I sent my withdrawal letter to them and still have not got my refund. Have been calling mayland office many times the past week and they told me there is some issue processing the refund in the accounting department. When asked to speak to the person in charge Mr.Goh he is not in his desk (what a coincidence)

I am expecting Mr. Goh to return my call which I doubt he would. If I can't recover my deposit within 7 days I will seek my lawyer. Any of you going through the same ding dong issue?
*
My letter was sent about 30 days ago. They promised a refund within 60 days.

They're certainly doing themselves no favour with the way they handling this situation. The whole thing is a mess and this goes viral like wildfire easily.

hi, terencemagpie. .
may I know u will get the refund of loan agreement fee from mayland or the bank lawyer?
*
I discussed with both parties. Lawyer agreed to refund 50% few mths ago, which I appreciated since they didn't held responsibilities for the issue. I recently talked to Mayland and they asked me to wait as they're waiting for decision from the top.

What decision though? To withdraw or to persue? There has been a lot of frustration on my side not knowing what to do. Seems like I'm one of the few that have yet to withdraw from this project. I was hoping to hit them on the clause of delay in construction which is in the SNP.

To decide how many % of loan agreement to refund to buyers who cancel. Yea a lot of frustration and at some point I even felt depressed for this matter as a newbie. Bought my 1st ever property and so unlucky cry.gif

Some of my friends are also waiting to hit them on the clause of delay.

hi, terencemagpie. .
may I know which lawyer firm agreed to refund 50% of the loan agreement fee? Is just the 50% of Legal fee or 50% of total amount loan agreement fee?
*
Sorry for late reply, been really busy this 2 months. I didn't get 50% but only 1/3 after deducted this and that. The title is "Refund of Unutilised Disbursement". The firm is Lee & YC Tan, they've been nice and easy to deal with.

I'll need to write letter to Mayland to get another 2/3 or as much as I can. I've total of 3 units together with my bro so that amount means a lot to me.

Hope it helps.

thanks, terencemagpie.
that's means u're already terminate the s&p.
I still in consideration. but I think will be cancel in next month.
*
Yes. My brother and I went to the Mayland HQ in KL to sign the cancellation letter around last year December. The girl we dealt with is Delia from finance department. She is new but friendly and helpful.

Once signed you'll need another month or 2 to get the money (-rm40 admin fee) back.

You mean they will deduct the RM40 from the RM5000 that you paid for the deposit? Then what about the loan agreement that you paid to lawyer but cannot refund in FULL?

As you said the lawyer only refund 1/3 to you... So you have loss of 2/3 on the total of loan agreement paid? Would you able to get this 2/3 refund from Mayland for the losses?

I'm also one of the victim, and don't know what to do...
*
Yup I got RM4960 for the deposit refund. For the loan agreement fee, I got back around 1/3 from the lawyer firm.

Means in total I still lost 2/3 on the total loan agreement fees.

Mayland is slow in handling this. The new manager Stanley Wong who handled our case asked us to write an email letter to request for the remaining 2/3.

Sadly the manager is one of the missing MH370 passenger.

Since I've got back most of the money, I've decided put this case on hold for a while first.

In this case, would you able to get the refund for the remaining 2/3 of the loan agreement from mayland? Is there any official reply from them that they will refund to your loss? Or you decided to let go the 2/3 loan agreement?
*
I'm not sure if I'd get the 2/3 loan agreement fee back. There is no promise from them. Stanley Wong dealt with us and advised us to give a try and write a letter. Eventually their boss will be the one making final decision.

I may still write the letter but mostly after March.

Hi Terrence,

Seems like you are the man to talk to. Anyway, I'm trying to get back my 5k deposit. I was lucky as just as I was about to sign the S&P, i found out what had happened and didn't proceed with loan agreement and S&P. So, who do I email my letter of request? Would you have a direct contact to someone who can process the claim? I've read about a person named Delia from finance thats being mentioned, do you have her email add? Thanks alot and appreciate your help on this.

HS

Her email is deliaphuah@mayland.com.my

She's the one handling refund but you may need to first request refund from someone else, probably from admin or sales department. Mr Stanley Wong was the one I emailed to but unfortunately he's a victim of MH370 missing flight.

Maybe you can email to Delia first.

Delia is not new. That's what she told me when I collected my refund and that was like back in December.

That's what she told me too back in November. That's probably an excuse not to get scolded (since she's dealing with many angry/annoyed buyers). blush.gif
