Household Worst Developer - Magna Prima Berhad, Please help to share the worst developer

Dear All,

I would need help by all parties to escalate this developer whom have been "stealing" money from citizen.

The developer (Magna Prima) was selling their property since year 2010.

The case is as follows:

Many buyers has paid at least RM 150k for the 10% deposit to the developer at least 45 people have signed up to buy the property.

Recently in June 2011, there is a letter stating that UITM is going to take over the property and all buyers are told to meet in the government office in Klang (although property is at Selayang)

After a total of 6 months of waiting and total of 2 meetings, we were told that we will be recieving our deposit back with a RM 300 attendance fee towards the meeting. (till today November 2011, we have till not receive any money back)

However, some people as mention has paid since November 2010 and one year the money at least of RM 200 k (deposit, stamp duty, and lawyer fee) has been paid to the developer and ended up, nothing will be payback but only the deposit + lawyer fee as verbally communicated.

This is so cheating to house buyer as we have lost other opportunity on the alternative purchase of property (every month, property price has been increasing like mad), lost of interest gain from EPF and banks.

Hi Kenny Yew, yes, the project has been called off in June 2011. all buyers will only get refund of the deposit, and lawyer fee. (buyers will lose out interest fee and stamping fee and all the lost of opportunity after waiting for a year to stay at their dream home)

There are many people whom have paid 10% if includes the lawyer fee and stamping fee it could cost up to RM 200 k per unit for upfront payment.

As mention, there were 45 buyers whom have bought the unit, some bought since November 2010 and the money was hold with the developer and it has causes all house buyers to feel that the developer have borrowed money from buyers without needing to pay interest to run their Business.

There is another project near the Hot Spring Selayang has eventaully delayed on the handover process as there was a CF problem.

Buyers for One'Sierra was launching a complain to the developer and the developer did not make any comment and ignore 50 + buyers at the area.

So at least, kindly please be reminded that at least Magna Prima Berhad has a case on cheating buyers.

Sad to hear this. This is turning out to be another T Corp in the making. You have to keep pursuing this developer constantly, and be on the alert before he runs away with everybody's money.

I'm never buying another property again in this place.

One must go after the persons responsible in the company. Who are the listed directors ?

these days, stil manyyyyyyyyyyyyyyyyyyyy want to buy properties at such unbelievable price even though recession is near. Manyt hink asia is in recession...aduh, belum datang sudah cakap sampai.

the prices are ridicilous, unless you are investor then it's different story.

I dun think Magna Prima is cheating, dealing with compulsory acquisition issue with gomen pertaining to the compensation matters might take some time, I dun think any developer is hoping this thing happen to them (after they hv launched their project and marketing campaign), I believe purchasers who booked Anggun can hv compensation on top of the deposit they paid to the developer.
Magna Prima still has 2 of the most beautiful lands in town to be developed, they won't simply jeopardize the reputation and affecting theirs' future sales.
Follow up closely with the person incharged to get the latest news.
One of Magna Prima director is Mr Manjit Singh, a very famous lawyer in town, perhaps buyers can seek advice fr him.
It is too early to judge Magna Prima with such a harsh accusation.
The title is more suitable for Talam Corporation Berhad (New name : Trinity Corporation Berhad)

Still long to go for recession. It is resilient. Don't worried. Feedback I get from the poll http://forum.lowyat.net/topic/2093540 say that nearly 30% is still thinking property is reasonable and cheap.

It is never about consoling the victims.
The topic is about how dev handle this situation. Look at how the TS reaction and his comments on this, it tell the picture how situation is handled.
It is whether the dev has not done a good job in handling this or not? It is about communication or assurance to buyer, or even some light what is going to happen.
There nothing I can do to make the buyer happier except for the dev

Dear all.

Thanks for the concerns.

Of course there is nothing to be happy about as 45 buyers have paid many sum of money to developer and due to the famous Tai Chi game they are playing around, the buyers emotion has been worsen.

There were buyer mention that this was a dream home as it's located about the cliff and they have been renting house for their whole life and the developer has broke their passion for buying a house in Selayang area.

Hence, this topic is to head's up on all the buyers that at least Magna Prima would not be even in your choice of consideration for choosing your property.

We were told that we will be receiving the refund document from the land office 3 weeks back but seems like there isn't any response other than hearing ringtones and musical waiting "hold" tone.

We are looking into filling a sue case to claim back the lost of interest and the money which we have paid to the developers.

It is unlikely to buy a property where the developer holds all your money in hand to turn over with their business. logically, this is definite a con or a some sort of misleading business solution.

BTW, anyone know how do we file for a sue case ?

Regarding of your statement, this is what we heard when we discuss with the developers.

We did not deal with Dato Manjit (which i know him in person for engaging him and his partner for multiple legal case advisor).

Land Acquired by the government was since June and buyers have been asking for their refund to seek for other opportunity.

it's like i've taken your money for the next 1 years not returning anything to you. would you be happy ? ?

Hi,

About Talam, yes i'm aware they were having the same problem with Port Dickson development as well.

however, no one make any complaints to the court and kept the case silence (most extend was to news paper)

but in official, i would think that launching an official case to high court will be the way to solve this issue.

i can understand the frustration be it for investor or for own stayer....

Well, i seriously think the BTS has to be implemented....if not full BTS, .at least owner only pay minimum until the property is completed.


Otherwise, in this bolehland, anything boleh !!! DEveloper bankcrupt, contractor runs away, developer cheating or short changing in material, unblieveable finishing, drag on progres, dragging the S&P signing (until get enough buyers), collecting booking without project being approved. etc...

I'm having the same bad experience with Magna Prima with the property purchase in Kepong. Bad workmanship! and low ceiling! Also beware of their legal advisor....very sarcastic and kurang ajar lady. Can't remember her name already.

Hi,

There are 2 concerns that i'm thinking.
1st there isn't any protection against the purchaser

I've seek the followings but no luck till now:

1) I've called the high court, response is that i need to engage a lawyer to sue on this case. @ 03 6209 4000
2) I've called 2 firms on this and both gave answer that it will cost not less than RM 10,000 to proceed with documentation and all related man power on this.
3) I've called ministry of higher education and were to speak to an officer name Cik Umamania, but no one has pick up calls. @ 03 8870 6000
4) I've called the JKPTG to look for the officer in charge, Mr. Zaim, and he was nicely to inform as that they are just the intermediate for Ministry of education and developer on this case @ 03 3341 4194
5) I've called ministry and housing government, no one pick up call @ 03 8891 4723
6) I've called consumers affairs @ 03 7877 9000

I think i will launch a civil police report to log a case on this matter. (which is the last solution)

anyone have any resourceful ideas?

I don't understand. You mean you cannot get hold of the developer at all? If you managed to talk to them, what do they say? Surely they have to tell you by when you will get your money back right? It is only logical that if you have paid deposit for a project and the project is cancelled, then you just wait to take back your refund right?

this is not even abandoned project as I assume no work has started.

well, we have all spoke to the developer, and the developer said that the money will be pay back by the government (tai-chi game)

but actually, the money we pay was directly to the developer and it has nothing to do with the government at all.

so in conclusion, the reason i post up this topic is because this is one true developer whom :

1) do not want to deal with buyer on the refunding status.
2) Tai-Chi game all the way with no promising date of payment to be release.
3) irresponsible by still selling property when the land officer have sent them a letter to restrict the property to be sold.
4) everything push saying it's the government (as you mention, we pay direct to developer, developer refund instantly)

so Magna Prima is a NO BUY property.

i can understand the frustration.....but let me assure you that after all this...i will not be surprise they would just register another company and everything reset to zero again. This is the problem with this sort of system....

The finance system also allow this sort of thing.....setting up a legal entity as ABC Sdn. Bhd for every single project....and then trying to tell people that the developer is actually XXXXX (leverage to the max)....but all your payment is to ABC, if anything screw up....they can just shut down the ABC....and set up another ABC2.....

Magna Prima is a listed company. They have AGM middle of the year. Maybe can consider buying 100 shares to attend the meeting.

Highlight this in the meeting. Let the shareholders know what's happening

Yeap.. Totally agree with you on this. which i would hope that (with finger cross) no other buyer during the transaction period of changing company name will buy the property for now...

Thanks for the advise, i've been there but still nothing has been done.

However, i've paid for RM 750 for Lawyer to issuedletter to both JKPTG and the developer. But no news for both until JKPTG recently mention that they have prepared the cheque.

I manage to collect back my deposit but the JKPTG, Cawangan Selangor is really not helpful.

We have been promise by Hanyati and Faridah that the cheque will help us to bank in 1 month ago, but eventually it is not done.

We have to make our trip to Klang to collect the money.

In conclusion, Malaysia sincerely have no protection against buyers and government department is seriously THE worst service.

for Home buyers, it is a risk to get a house with leasehold title and i've lost more than 5 K (Interest, multiple meetings at KLANG office, Lawyer Letter, Signed S&P, Unpaid Leave and etc)

this is call BN boleh, Malaysia Boleh... haiz...

I'm one of the buyer of Prima U1. What I can comment is "dont buy property from magna prima.

Elevator is main issue that every residence faces.
The brand used is Dov_r, and is really suck. This building is just less than 6 months, but the lift is malfunction EVERYWEEK.
The quality of their work/material, is not as CONDO level. Sometime, I wonder am I staying in apartment, not condo.

Think twice before you buy from Magna Prima.

According to wiki original Dov_r (elevator specialist in US) was sold to a german company (a very common name in Malaysia after otis and schindler)..

Not sure about Dov_r in Malaysia though..

May I know the status of your case? I understand the frustration you are going through and I would like to advise you to keep a log of activities that you have performed. A simple spreadsheet will do.

For example:
- the date and time
-whom did you liase with?
-and short description in the activities, follow-ups or action being taken.

Remember that every verbal conversation be followed up with a written communication.

In addition, every meeting held together with the authorities or developers must be minuted.

Keep all the correpondence and letters and filed up properly in a safe place.

All the above is very important in the event you need to bring this to court.

Just to share with you some of my experience.

Dear All,

It's been sometime and yes, after going thru multiple disclosed steps and procedures, I am able to collect back the full refund + RM 100 for travelling fee.

I'm in the court case to use the developer on the misleading information which leads buyers to purchase the property. (as mention, property was hold to sell on July 2011 and I bought it in August 2011).

My lawyer are claiming a compensation of lost of RM 12k.

Just to keep in mind that, the developer (Magna) does not response to you and will keep on delay you on reply, either with the same old story saying that their staff has been reassign or resigned... which it's none of our consumer concern as that's the company administration matter.

It's not because it was Malay (please don't be racist, we are merely linking to boycotting towards the unfair developer), most directors was link to politician parties for Umno and BN. you can easily check from board of directors information in 2011 and if you do invest in Shares account, you can have access to information easily and cross check with the member list in Umno and BN.

We have been to the following steps:
1. launch public complain
2. launch police report
3. launch complain to housing development and ministry department

All the above have took more then 3 -5 months of waiting but did not work out. The last resources is that we went towards both political party as last resources to seek help and opposition responded quickly and have our problem solve - fast. imagine 80k - 100k, the deposit you have are place at other people's hand with no interest gains. how will you feel ? you could gain 3 % from FD, 6.6 % deduction of home loan.

I'm no politician and bias, but it's politics that roles your country which also indicate the level of service you received. Political parties are important in any country.

Abandoned I don't know. But they were developing some houses in Seksyen 17 Shah Alam. I almost wanted to buy a unit there. Glad I didn't.

I'm not sure, but be aware with any subsidiary company whom is linked to Magna Prima.

The last I bought was from a developer name Crossbuilder, with a small font size written next to it says : a sub division from Magna Prima.
