Need advise urgently.

Recently, I traded in my old car to a second hand car dealer and the ownership was transferred on the spot using online system (Sistem Tukar Milik Sementara). Then, the dealer sent my old car to Puspakom for B5 inspection. The inspection result failed because the car was cut and joint.

With the failed inspection, does that mean the ownership transfer which was done using the online system earlier is not valid anymore? Is the car still under my name or under the dealer name?

The dealer kept saying the car is still under his name which doesn't make sense to me because the inspection had failed.

And the dealer wanted me to refund the money to him. I am ready to refund him provided the car is still under my name and I get back my old car and the car registration card.

Under Sistem Tukar Milik Sementara (STMS), the car is permanently registered under the second hand dealer name after 6 months if the dealer didn't manage to resell the car.

In my case, the dealer won't be able to resell it anymore because the car has been blacklisted as kereta potong. It failed Puspakom inspection.

What that means is my car is a junk now. I have to write it off as total lost.  I am a loser here.

Lessons learnt from here is when you send your accident damaged car for repair, make sure that the workshop doesn't use patch-up method/cut-and-join method. I suspect that was what the workshop did to my car 13 years ago and the method is not considered illegal back then.

Q: How did this practice of joining two halves of a car start?

A: A few years ago, there was a lack of guidelines and it was not mandatory for inspections to be done on cars. The cars should have been considered total losses but insurance companies chose to salvage them.

Q: Why was this done?

A: To save money. The companies did not want to pay the full claims for a car that should be written off, so they gave the go ahead to “fix” the car. It is a cheaper and faster alternative to fix one half of a car to another than to fix the car’s bonnet or bumper individually. 

Q: So is it harder to get away with it now?

A: Since mandatory inspections came into force in 2005, the kereta potong are being identified.

Is there a quicker procedure if I just want to transfer car ownership to a family member?

I am currently planning to let go my Proton Wira which is immovable condition . (not sure what spoil but mechanic confirmed not engine problem.
Problem is can I do ownership transfer on this case?
How do I pass the puspakom test or is there any exemption for it? The car can not start now..

This agreement letter is created by my cousin who work at a lawyer firm...i used it only once ,so kinda waste to delete the document file.
