After 4 pages of discussion, I still dont understand the issue. Like I said, it is only 3.3% of the total cost! It is the he says she says thing. If you dont itemized all the changes with variation orders, then you can argue until the cow come home still can't resolve.
I made it very clear to my subcon that any work started without me signing the variation order I will not pay for it because I would not have budgeted for it. That would be the "free work" thing. If you think that for RM150k, you can lump a lot of free work in there and without the clear understanding, then that's the issue.
Clear understanding already made during the process....All agreement already been done....the problem is he don't admit after done...I made it very clear to my subcon that any work started without me signing the variation order I will not pay for it because I would not have budgeted for it. Example, 150K including building a staircase(free - Clear understanding + agreement has been done)..after staircase has built, one month later, request money of staircase from me...said the staircase cannot be free, need to pay money...
P/S: If you are contractor, will you build the staircase without any agreement before that? Can you manage to force a contractor to start doing for you FREE? unless I am a gangster and holding a knife....
It is not the agreement problem, not the communication problem, even not my problem because we already discussed and agreed each other..It is his integrity problem..his behaviour problem..
