If I buy a CPU by parts(eg. Monitor, casing first, then HDD,memory, cpu, motherboard later) , is it eligible for the tax relief?
*
If all the parts are bought within a reasonable time period and it adds up to a full working set then YES,

you can fill in the 'pendapatan belakang' or something...just declare it as it is part of your responsibility to declare your salary even if no tax.. somebody once mentioned that he was fined because he didn't declare his income tax even though the tax was nil. normally LHDN people will audit you when u want to withdraw your EPF or something like that..so have to be careful.. blush.gif
*
There's no fine if tax payable is NIL coz max fine is 3 times of tax. So if tax =0, fine 0 x 3 =0000! whistling.gif

got 2 category one.

(a) penalty that is 3 times of tax, or
(b) fine between RM300 to RM2,000

if tax payable is NIL then u have to pay the fine under (b)
*
The fine under B is if you receive AR REGISTERED / Tax officer hand delivering forms to you - and you did not returned it within 30 days. Not that easy to be fined under this section

Hmm...

For self employed people, let say their monthly earnings is RM15,000. But in the form, the state there RM5,000. Can they cheat?

No sdn. bhd. or enterprise company. Like a char kuey teow seller can earn that much, but I don't think he's that dumb to put RM15,000.

Yea my question is, can they really cheat? smile.gif

Yes this is quite an interesting new item for Tax2009. The question is, how will we know how much of our monthly payment goes to the main amount (not sure the exact tem, base loan?) and how much goes to interest? We ask the bank?

so the bonus 2008 is add into "Penggajian " or "Dividen" ?

In my EA form, bonus 2009 is filled in "Dividen", therefore can I assume that bonus 2008 will be same as bonus 2009? declared it into "Dividen" column, just add it together with bonus 2009?
*
All bonuses(irrespective for which year) paid in 2009 is treated as employment income for 2009. Bonus is NOT dividend. Dividend is profit distributed from shares in public or private co's/coops. Declaring in bonus in dividend column is FALSE declaration.

Hi, I’m still having headache filling up my BE Form. There’s a section D8D where we can get deduction for ‘Faedah Pinjaman Perumahan’.  We’ve bought a house but it was under construction and we only have to start paying the installment s and interests upon completion, can I still get this D8D deduction?

If yes, how do I calculate how much deduction to write for section (since we’re not paying for it yet)?

As per its condition, the S&P must be signed in between 2009 till 31 December 2010. If we can only get the deduction after we started our installment which will be in 2010 income tax submission instead (house to be complete end of 2010), I’m worried the required S&P signed date will become 2010 till 31 Dec 2011. Then our deduction will not be valid anymore because the S&P was signed in 2009!
*
One of the requirements is for S&P signed between 10Mac 2009 and 31 Dec2010. Therefore according to the info you provided ,you are eligible for relief for 3 years- 2009, 2010 & 2011
The relief is for interest incurred . If you have not being charged any interest yet that means you have NIL to claim for 2009. You are still eligible for interest paid in 2010 & 2011 if there's interest paid.

Tolak : Jumlah tolakan/pelepasan cukai
(Pelepasan cukai seksyen 132 & 133 terhad kepada jumlah cukai yang dikenakan)
Less : Total tax deduction/relief (Section 132 & 133 tax relief restricted to total tax charged)

I do e-filing. I key in the Gross Dividend received, and the tax deducted from this Dividend. Funny thing is, this tax deducted appear under the line "Section 132 & 133". I thought it should appear under section 110? A search from the internet revealed that S 132 & 133 is related to Double Taxation. Is there something wrong with the e-filing?
*
Look at the form again carefully. It does not appear in the Sek 132/133 column. It appears in the tax deduction under Sec 51 Finance Act 2007 column. as it should be.
Company dividends no longer appear under section 110 effective 2008.

There are total 6 pages in e-filing.
1.  Maklumat Individu | Particulars of Individual
2.  Pendapatan Berkanun &  Jumlah Pendapatan | Statutory Income and Total Income
3.  Pendapatan Tahun Kebelakangan | Income Of Preceding Years Not Declared
4.  Tuntutan Pelepasan | Deduction Claim
5.  Tuntutan Rebat / Tolakan Cukai /  Pelepasan Cukai | Rebate Claim / Tax Deduction / Tax Relief
6.  Rumusan Cukai | Tax Summary

Goto the last page, summary. The tax dividend paid is listed as

Tolak : Jumlah tolakan/pelepasan cukai
(Pelepasan cukai seksyen 132 & 133 terhad kepada jumlah cukai yang dikenakan)
Less : Total tax deduction/relief (Section 132 & 133 tax relief restricted to total tax charged)
I'm wondering if this is a systems glitch. If I click "submit", will I be penalised later for wrongful submission? ie, claiming as S 132 & S 133 instead of Section 51
rclxub.gif
*
For dividend you have to fill in the HK3 form Link in page 2. It will auto calculate the gross div & section 51 relief and auto fill for you . You DO NOT have to manually key in the set off. For Co dividends if you manually key in the gross and set off means you have done something wrong

Can put my life insurance in this column?
*
As long as your life insurance + epf does not exceed RM 6000. The extra RM 1000 is reserved for annuity scheme. If you do not know what is an annuity scheme - you are not qualified to claim tongue.gif tongue.gif

REIT is tax at source, no need to declare and there is NO refund/set off for the tax. The tax is a final tax.

No need to wait until you start working.

Exactly the same as my situation many years ago. I have zero income but only dividend. So I wrote to Income Tax Department to open a file even though I was just  a student. I submitted the dividend vouchers every year and got back the tax deducted in full. I was only asked where I got the money to buy the shares, and I replied that my father bought the shares under my name. It is also because of this pro-active practice, my tax file is always in order, and I never have any difficulties in getting my tax refund.
*
This is a two edge proposition. Coz when you file on your own your prents will not be able to clain child allowance on you (RM 4000). So you can get back your tax credits but your parent rugi. Also if your parents continue to claim then they will run foul of tax evasion.

QUOTE(salcom @ Oct 9 2010, 02:02 AM)
Hi there,

I'm working on a Malaysian registered DP vessel on Malaysia waters, mainly offshore Labuan, Terengganu and Miri

According to INCOME TAX ACT 1967, Section 54A. Exemption of shipping profits, I seems to entitled for some kind of exemption from tax. I'm on contract basis, which i don't receive monthly salary. The company is paying my EPF, SOCSO and deducted PCB from my salary. I've been submitting BE for two years and pays my taxes as a good citizen should do.

my question is:

1. What is the reason behind for being tax exempted?
To encourage investors to own and operate Malaysian flag ship.
2. Is there any specific kind of vessel apply to this? or just any type of vessel?
3. If I am exempted, what kind of documentation i need to prepare? What is procedures to claim the money back?
Crewman on 'Malaysian ' ship is exempted from income tax. - MALAYSIAN SHIP = a sea going ship registered as such under the merchant shipping ordanance 1952 other than a ferry, barge, tug boat, supply vessel, crew boat, lighter, dredge, fishing boat or other similiar vessel.
4. (I know is impossible) Can i get exempted for what i had paid in the last 2 years? Sure if you are eliglble for the exemption, provide the EA from the shipping Co & confirmation of the ships registration & shipping schedule to your LHDN office.

thanks for your input, i appreciated

I found this
"Increase in relief on contribution to Employees Provident Fund (EPF) and life insurance or deferred annuity To encourage Malaysians to participate in retirement scheme, it is proposed that the tax relief of RM6,000 for EPF contribution and life insurance premiums be increased to RM7,000. This increase of RM1,000 relief is for relief on annuity premium paid from 1 January 2010 for retirement schemes offered by insurance companies. This increase is also applicable to additional premium paid on existing annuity scheme commencing from 1 January 2010."
I bought HLA Wealth Builder, can I claim the 1000 tax relief as deferred annuity?
*
Is it an annuity? Check your policy. If you do not know what an annuity is then most probably you cannot claim for the extra RM1000.

Wasn't sure if you were agreeing or disagreeing so I thought I'd elaborate.

Take note of the bold part above.  To be "derived from outside of Malaysia" your business cannot be operated in Malaysia.  So if your business is operated from Malaysia, no matter where you sell, your income is derived from Malaysia.

Derivation rules do not look at the location of your customer.  They look at the location of your operations.  If you are selling to Thailand, from Malaysia, your income is derived from Malaysia for tax purposes and you do not get this exemption.

hi need to enquire about rental income tax. Let's say i have a house which i am paying RM1k for installments, and getting RM1.5k mthly for rental. Am i going to be charged at a flat rate of RM1.5x12mth or RM1.5k minus RM1k x12mths for tax?
*
Very simple example

Gross rent = 18k (calender year)
less
interest on loan say 6k ( not installment paid)

Nett rental = 12k (taxable)
