Since Sunrise is developing it, I am not concerned about the development and handover. But is there anything in the law which says it you use a commercial unit for residential and thus certain things are not protected ? For example might be if the the building is on fire, then the insurance is not covered because you use it for residential or something of that similar nature ?

good test for developer would be for them to confirm in writing (not verbal lah) that it can be used for residential..just becoz they provide gym, pool etc by law can owners infer that it can be used for residential ?

Pricing wise circa RM850psf i think fair given that
1. Absolute price is affordable given the size
2. CBD location
3. Close proximity with hotel, malls, LRT, Monorail
4. Reputable developer
5. Freebies ie AC, Heater and Fuly fitted Pantry and Tiles Flooring

Most office suites just give you roti kosong not even tiles on floor. Even Binjai8 and SOHO Suites with SOHO concept is roti kosong and selling much more expensive.

this one not leh..how to compare ..for me, i rather go for true blue type than those riding on the skirt tail of
KLCC..

the lobby looks like a typical office lobby but inside the units they have been furnished as residential..

even under iprop - its under "condo".. rclxub.gif

you mean to say the developer did issue an official letter to all owners to say that its not for residential
use?

The enforcement of this ruling will not be easy but if official complaints are filed, it really can get very messy
for the owners and tenants.

there are plenty of legal implications if owners are renting out as resi when infact its for office use..

developer make sure they are not held liable thus for the notice in August 2015..rent out at your own risk!

one of the main issues I would worry about is the insurance for the building - will this void the entire coverage as far as the insurers
are concerned since the building is being used "illegally" as residential when coverage is for office? this will be a non issue if nothing happens
but if it does?

at the end of the day, who will come and check anyway ? guess owners will just do what they want until there is some form of enforcement or clamp down..

Basically, there won't be authorities coming in and making trouble? Why? It isn't illegal. Only downside is paying utilities and assessment at commercial rates. Other than that you can do what you want. If it was illegal then shophouses and whatnot would be raided for breaking the law since eons ago.

I hope we can move on from here on because its very tiring to see the same topic harped on again and again.

ever asked the developer whether its "illegal" or not? guess they are the best people to advise since they applied
for the permission to build the building..

we can say all we want whether illegal or not but at the end of the day, we don't have the authority to state either way so better to check with the right entity..

I don't really think people will harp on this matter if it is not an important matter -am sure buyers would want to know ..shall I say most buyers? brows.gif

if I am in the market to buy I would definitely call the developer to get a confirmation on this issue...

SS was built as an office development - ie not as serviced apartment nor does it falls under those hybrid types ie sovo, sofo and what not..so I think your argument is a bit off the mark..

the developer has reconfirmed that SS are offices ..so there is really no grey area as its clearly stipulated in the SPA.

anyway, for the owners, they rather have it used as residential rather than offices as the rentability is higher..

SS could set the precedent for other office developments to be used as residential? time will tell..

so when is an office block an office in the real sense of the word? PETRONAS twin towers , maxis - offices for sure so
if someone wants to turn into residential, then no problem also if we based it on SS case?
