Following the amendments under the Housing Development (Control and Licensing) Act 1966, the failure of all licensed housing developers to complete a housing project or causing the abandonment of the same shall be considered a criminal offence.

Provided under a new section in Clause 9 of the Housing Development (Control and Licensing) (Amendment) Bill 2011, a developer shall be liable to a fine between RM250,000 and RM500,000, or jail service of up to three years, or both upon conviction.

The new section is one of the several amendments made to the Housing Development (Control and Licensing) 1966 (Act 118).

Inserting a new Section 18A into Act 118 aims to overcome abandoned projects and provide home buyers the rights to take legal action against errant developers, as stated in Clause 9 of the bill.

This provision covers all developers who refused to continue or have postponed or suspended or stopped the project for a period of at least six months, or exceeding the original date of completion stated in the SPA.

The bill was read for the first time by Housing and Local Government Minister Datuk Seri Chor Chee Heung (pictured) in the Dewan Rakyat on Wednesday. When passed, it will be known as Housing Development (Control and Licensing) (Amendment) Act 2011.

Moreover, Clause 5 of the bill, replacing Section 8A of Act 118, will give buyers the right to terminate the SPA if after six months from the date of the agreement, the developer refused to implement the project.

Bro, you are right. But on grounds of commercial title own staying, rates can be discounted. Same was done for my service apt when VP
