sue you? why? i too want to get down to the bottom of this but if you are basing your opinion on hearsay, rumours, wild guesses and gut feel then you are not helping any. Sure, label me as
TM helper or whatever if you can't get the better of an argument or any argument for that matter.

It's very easy, they just need to configure QoS at their core routers/switches to "expedited forwarding" or "assured forwarding" mode for traffics going to SpeedTest.net, others traffics will be set at best effort basis.
