Guys, i have a serious problem here..my ex wife didnt pay house loan that under is my name for 15 months..15 months ago, me and her went to lawyer office to sign documents and the lawyer told me everything done dont worry..but yesterday to my horror i went back to the back to apply for car loan, my name kena CTOS delay payment for 15 months..she still staying in the house and she haven answer my call now.. my shoud i do guys?

ya sell the house then problem solve...but u might get only little profit from the house ler.if u can afford to pay the 15month delay, then just pay and kick her out.wat ever happns the loan still on ur name and u will kena.no need to blame her or get angry at her now...first thing first...clear ur name.

myb the bank sent letter to ur house but ur ex-wife didnt tell u?

ya she didnt tell me.. this is not the first time.. last time when i went to Australia and work she also never pay for 12 months.. thats y when i came back that time i faster ask her go lawyer office to settle it..i dont mind the profit.. i just want my name clear.... bad week for me.. that day kena rob lost 2 iphone and 1 laptop.. now this.. haizzzz

I think if 9 years ago 178K then myb u can get around 230K...depends on ur location and house type.u settle the payment first then sell la.I dont think u cant afford 20K laugh.gif

I remember selling my mum's 24years old house (teres) bought roughly 60K, loan settle around 90K sold around 150K. this one is in KK sabah.

its nt easy 2 get 20k meh..
nt even in a month..

Hi.

Hm. Usually, if your housing instalments are in arrears for three months or more, the bank will ask their lawyers to issue you a Letter of Demand, asking for the instalments in arrears.

If you fail to pay again, they will issue a Letter of Termination, indicating that they will terminate/end the housing agreement with you and thereby they wont hesitate to start a legal action against you.

Therefore, at this juncture, they will issue a Summons against you...and if they dont receive any payment from you, and still, and the legal proceedings will go on and on..till a bankruptcy stage.

That means..the bank will make u a bankrupt. They will recover the arrears by selling the house through an auction.

Once u make bankrupt..there are alot of things ensuing, for eg, you can start a business, buy any property, go out from Malaysia, etc.

sell the house through property agent. Don't let bank auction it cause you will lose even more money as it will most probably be sold under market price.

You have to looks for temporary amount to settle the outstanding amount first or else you won't be able to sell the house.

Maybe you can talk to the bank and see if they have other solution for you.

Your life seems to be in a mess. Try to get it sorted out.

BTW, did you pay your wife the money to get her to pay the house loan? If yes, then talk to your lawyer to see what can be done about this. You still have to pay her how much alimony?

No.. i didnt pay her. when we divorce that time.. she didnt ask for anything..she already married to another man now. Haizz 15 months.. i wonder y the bank and lawyer didnt call me up.. cant sleep now.. vmad.gif


Added on November 6, 2010, 6:52 pmi manage to call her today.. she say she have no money now..i ask her to move out.. she say she will settle in few months time...i doubt she can pay.. what should i do now? ask police to chase her out??

Yo Bro,
Take it easy,stay calm and you will get things done.
Since the house is in your name,the bank will not hesitate to take action against you. All banks the same, 'During sunny days,they provide you with an umbrella, but when it rains,they will remove it !'
Get an agent to value the house and sell it off,or else you will have problem buying a car, house, or applying for credit cards in time to come. Your name will be blacklisted until case is cleared. On your bank loan against the property,if the bank auctioned it off below your loan balance,they will still pursue to make you pay the rest of the loan. If you have sell the house,buyer/seller has every right to evacuate the occupants. Be sure to put a caveat fast before she does,or else the house can't be transfered.

go to the house and chase her out, then look for buyer fast fast and use the cash down payment from the buyer to settled the 20K outstanding, if your property is in hot area then should be ok.

or

renegotiated with the bank on waiting a month or 2 for you to get the buyer as the do not allow you to sell the property cause the selling process might take 4 to 6 month process before the bank can get the money.

not so easy....she might be able to put a caveat on the house. then you'll be worse off. best thing is to speak to a lawyer to see what you're options are. then only proceed. good luck mate.

i meet her again today. she say she will settle this mess end of this month.. but i doubt it cause her name i think already in CCRIS cause she didnt pay her car loan and cc debt..i check with the lawyer already if i sell my house now no need to wait 4-6 months cause all the documents (Mb concern etc etc) already got it. only need to find a buyer. check with the bank again today.. total i owe them is RM 194k.

call the bank, ask them to give you time to sell the house off...that is the best solution. Why in the hell do you still leave the house to her when you have separated? Is the house yours or you give it to her?
