Hi Dario,

Someone said you're good and I read this thread, found that most questions you answered without hesitation. So, I've got some questions would like to seek advice from you, based on this thread, http://forum.lowyat.net/topic/1854925, which just opened by me. Anyway, I get to know that 1st MOT (to transfer the Strata Title from Developer to Vendor) would take much longer than 2nd MOT. Here are my questions, hope you can give some advice:

1) Why is this 1st MOT take so long? What actually are the steps?
2) Anything I can do to speed things up? I've been waited 6 months, and got the answer from my lawyer that I need to wait for another 6 - 12 months for the 1st MOT done.

1) Can't say for sure as you need to take a look at all the documents involved to see where the delay's coming from. Perhaps it took a long time for the land office to issue a notice that strata title is ready. Perhaps the developer or the vendor took ages to put their John Hancock down. With regard to the steps - it depends on the type of title also. Is it subject to state consent? Has blanket consent to transfer been applied by the developer? Perhaps there is a delay there.

2) You can sack your lawyer and do it on your own. Perhaps you can have better control of things if you're doing it yourself. I know some people who did it like that. Fellow forummer Hansel in the earlier posts of this thread told of the story of some purchasers took over from the hapless developer andcompleted a development project themselves. Perhaps you can explore that option.

Hi Dario,

1) All I know is, the Strata Title for this condo is out ages ago, and the vendor never do the transfer. So the vendor is doing the 1st MOT, which is from developer to vendor, and then 2nd MOT, vendor to purchase (my name). But this 1st MOT already taken so long. Anyway, does this 2nd MOT need another SA consent to complete the whole process? And what is this blanket consent?

2) I've paid full to the lawyer, after signed the s&p she demanded full payment minus the stamp duty. So sack the lawyer is not the option, and I don't think I have time and knowledge to do all this things on my own. What i mean to speed things up is anywhere I can help like, go to Land Office myself and chase them, etc?

Hi Dario,

What can I do if my lawyer, fully paid, not picking up calls or replying sms? I'm not haunting my lawyer like calling/smsing every hour, just that my lawyer promised to prepare some docs for me to chase Land Office, and already due for a week.

2) Can do back to back transfer. Then the only thing left in between is adjudication by LHDN. That won't take long nowadays. Fastest can be roughly 5 working days, and 10 working days latest.

PS: Is it too late for the developer to agree to do direct transfer of title to you? Furthermore, vendor does not have to pay stamp duty. See your luck if developer agrees or not.  nod.gif

Hi,

I've been through all these recently, as recent as few weeks back. So, I just wanna share my experience. 1st of all, do you know the 'currently in the process to transfer to the owner' is at which stage now? If the developer lawyer has 'presented' to the Land Office, then they will have the Presentation slip, with the number, you can check the status in strata.selangor.gov.my. The last I checked with Land Office, a week or 2 back if I'm not mistaken, they're currently processing cases for year 2010 Nov and Dec. You can check it with your date on the Presentation slip, then you can roughly know how long more to process. And you can forget the 'Computerization System of Strata Titles', the system is only running for Landed properties, not condo.

Normal procedure, my date on Presentation slip is April 2011, Land Office staff told me probably the process can be finished by Oct 2011 but i doubted it. You can appeal with the Land Office to speed up the process, if they accept it, it'll take about a month.

If you haven't reach to 'Presentation slip' stage, yes, I would say it probably take a year or more, to transfer from developer to vendor and to you.

What's the different between Consent to Transfer and Consent to Charge? Does these 2 involve in Land Office? Which Consent execute 1st?
