Hi People,

So, the story goes like this. I bought a house, paid the booking fees at Oct 2010, signed the s&p at Dec 2010.

During the viewing/pay booking fees, property agent told me that, oh the current owner is already processing the 1st MOT. So, it would takes approximately 6 - 8 months to finally complete the 2 MOTs (3 months for 1st MOT, developer to current owner; another 3 months for 2nd MOT, current owner to me, 2 months buffer period). By the time i would get the key at around June/July.

During signing the s&p, my lawyer told me that, oh 6 - 8 months that agent told u probably fast and smooth MOT process, but expect a 12 months. Ok fine. I can accept it. At this stage, lawyer is fully paid for their's PROFESSIONAL FEES, only stamp duty not paid.

Recently, as recent as in this week, i called my lawyer to ask for status, my lawyer told me that, oh the developer already signed the i-don't-know-what-papers, i-don't-who gonna do what-kind-of presentation, and the Land Office i-don't-know-gonna-do-what, so start from now, it's gonna take 6 - 12 months for the 1st MOT done. Well, at this point i was like WTF? I've already waited like 6 months, now only start 1st MOT, and its gonna take 6 - 12 months? And then what? 2nd MOT takes another 6 - 12 months? So in total i need to wait like 2 - 3 years to get a SUBSALE HOUSE KEY?


Here are my questions, i hope somebody can advice me/share some info with me:

1) Why is this MOT take so long? What actually are the steps? All i heard were, developer have to sign docs, don't know what presentation, and then what SA consent, and then the Land Office, and then 6 - 12 months. Can somebody provide some details here?
2) Yes, what is this SA consent?
3) Why does some subsale takes only 3 - 6 months after s&p signed to get the key?
4) What i can do to speed things up?


Please, somebody please advice me/share some info with me, i feels that every other parties (my lawyer, property agent) doing nothing or my case in low priority after they are fully paid. Leave me in the dark and know nothing, all they say is wait, wait and wait.

Best if you post this under Dario Foo's thread. He is the in house legal adviser here.

1) I believe you are buying a master title property that needs state consent. SA should be State Authority. The SPA you sign should be a conditional SPA, whereby the vendor needs to get the property transferred to his/her name before transferring it to you. Perhaps Strata Title has just been issued which will make things slightly more complicated.

3) I think once the property has been transferred to the vendor's name, normal condition for SPA will apply which is 3+1 and not another 6-12 months.

Where to find this Dario Foo's thread? Anyway, for point number 1, what's this between master title vs strata title? What i know is, the strata title is out long time ago but current owner never do this MOT. For point number 3, you mean 2nd MOT is way more faster than 1st MOT?

Yes 2nd one less cumbersome as the vendor would have strata title already and would be quite fast. The first MOT, the vendor needs to get the strata title from the developer and that process in itself would take a bit of time. Dario foo's thread is pin right on top called Lawyers Corner.
