I would like to post this to warn all LYN member, Don't buy handphone from there!!!

I have bought this iphone from a kiosk called M.MOBILE at Low Yat (1-K002, 97TH MOBILE SDN BHD) on Monday around 7pm.

After I paid using my credit card then only the seller called Daniel showed me the iphone that I bought. For me, it looks brand new just the way he told me that the iphone is new.

After observing the iphone for a while, I handed back to him and he assisted me to put in my sim card in it. He also helped to change my case holder into maroon as part of accessory and protection. After done that, he handed back the iphone to me again to see and try out the application inside. There was nothing much I can check since the battery was low, as low as 5% left to be used.

He said that I should charge the battery for 8 hours and while charging I can still play around with the applications. At that moment also, he actually wanted to download some more applications for me but because it was already late so I told him that I would come again tomorrow for the services. By that time I consider the iphone was okay because I can message and I used the camera.

Around 9pm on my way back, because the battery was flat, the iphone turned off automatically. Once I arrived home, I started to charge the iphone according to the user manual. About 10min after charging, I tried to switch on the iphone, but it didn’t switch on as I expected. I remembered that the seller said I should be able to switch on during the charging process.

I had a look at the charger’s hole and making sure the iphone’s extension fits well to it. Even by doing that, the iphone still not switch on. The next day, I went back during lunch hour to the place and asked the same guy to check for me, my iphone condition and said I’ll be come again after working hour. However around 3.30pm later he text me and accused me removing one of the two screw in between the charger’s hole.

At first I can’t get what he meant of the screw because I don’t even notice there were screws on the bottom of it. I called him and said I don’t know anything about removing the screw because I don’t even have screw driver to do that. Then in the evening, I went there with a colleague friend to meet him and understand the root of the problem.

Over there, then only I get what he meant by the missing screw, all I can say was I didn’t do anything, they should know more because they are the retailer. He said the iphone was fine on the day he sold to me, only after he sells it to me the screw gone. I said that is unfair to accuse me like that and I demand a new iphone since I used the iphone less than 24hours and I didn’t do anything that caused the defect.

Even if he can’t redeem me new iphone I insist for refund. He replied me that he can’t do any of that, he offered for the repair and it is not free of charge. I have to pay additional for it. He also mentioned that the other way is to trade in with half of price I bought. I asked for warranty and he said there is no more warranty since I ‘lost’ the screw myself. I don’t know how much it will cost but it could reach hundred by looking at my iphone condition.

I was so angry that I took back my phone without letting them to repair and bring it to other shops and get second opinion on the iphone. Then I went to the repair shop, and the repairmen said that my iphone is not new instead it is used iphone. I realized, I got conned and what disappoints me most is that I paid for new iphone price and I used it less than 24hours.

Need some advise here, please help!!!

To TS, just want to mention that iPhones are by design like that. When the battery runs flat and you charge it, you will not be able to switch on immediately. It will wait until it has enough charge before you can turn it on.

I have two iPhones and both are the same. I need to charge it at least 15-20 minutes before I can switch it on. They're just designed that way. Hope u resolve ur problem soon. Good luck smile.gif

I dont know bout iPhone 3G or 3GS, but I do have & still using iPhone. When battery goes flat, & I connect to charger, it will turn on automatically less than a minute..

I think it's when the iPhone has 4% remaining, it automatically switches off. But if you don't charge immediately and leave it until the battery drains to 0%, it takes longer to charge before you can switch it on.

Be careful when buying stuffs from Low Yat. Once i wanna buy a laptop and told the seller to give me a new sealed set. Instead he gave me the display set which was also faulty. Luckily I'm able to detect it myself. Feel sorry for you TS. Many dishonest ppl nowadays.

What you can do is to report this to the Kementerian Perdagangan Dalam Negeri, Koperasi Dan Kepenggunaan. Lodge a report with them and create a police report. You can charge the shop for selling used stuff as new. Somemore if I am not mistaken, you can check with Apple website using the serial number to prove that it is not new. Get a printout for that and include it in your police report.

Ya Ts , go to his link , check your set see how old , print it out ..... Anything of receipt stating its "new" or " used " ? Your serial number written there ? Then check out this website ..... http://www.nccc.org.my/v2/ . . . . Its for consumer complains .... 1 word of advice , don bother mentioned about your batt and warranty , they will just blame it on u , saying its your fault for removing the screw , not theirs and even if its a new set , your warranty will be void .... Just stress on sold u a used unit but claim its new .... Good luck

well..a few word of advice.

If you are going to buy handphone from these shops and especially kiosk booth, make absolutely sure you check the phone completely. If you have no time then better don't.

Another mistake you have done is paying first before checking the phone. You must insist on checking the phone and testing everything before paying. If they refuse then just go to another shop. There are no reason to buy from these kind of suspicious shops. If you think...this shop selling cheapest...I don't wanna lose the deal. Well...it's too cheap to be true.

Last piece of advice is you can only go report them in Consumer Association and Tribunal Court.

Google for consumer association malaysia and tribunal court malaysia.

Goodluck.

almost 2k phone no warranty? wow. y TS did not buy from maxis? u can get 500 MB free internet each mth some more.

i thought there is a cooling off period if we bought something over 1.5k .

better lodge a report n show them, and inform them further action will be given if they do not comply.

visit a lawyer and send them a letter and ask for compensation and all the inconvenience cost. i think u can get back more than 2.5k. biggrin.gif

good luck bro
