hi guyz,

i have general question about scam, i'll like used your experience. here's the chronology :

if we got scam by someone, but we have their SMS regarding the transaction & Bank detail. the question is

1. Will police take action & find the scammer and bring to justice
2. will we get back our money
3. Will Bank freeze their bank account / blacklist him

No.

Imagine you go to your neighborhood electric shop to buy a water heater, you paid at the shop and there after they are suppose to come over to your house to instal it but they didn't.

YOU have to take action. You have to sue them (tribunal court for axample) for your money back.

In the case of a scam. You have to prove that the person "trying" to sell you something sole intention is to scam. Delaying in fulfillment of a particular contract is not a scam. It is not the Police liability to Prove to the court for you.

couple of thing you need to do
a) locate the vendor/seller in order to serve the court notice, failing which, you have to advertise the court notice in the newspaper.
b) sue the vendor/seller for your money back or try to prove to the court (in the vendor/seller's absence) that the vender/seller is a scammer

3. Will Bank freeze their bank account / blacklist him

after you have done the above, Yes.

We, Malaysia is a democratic country with functional legal system. Only totalitarian country the policeman can go out arrest someone, put behind bar without asking for reason.

SMS and police is a messy issue. At one time, someone I know was asked to prove (written prove) that he received said sms (how to prove? I have no idea) before the police here will do any document filing. Bringing the handset containing the sms itself isn't enough I guess.

Then again, the police department over at my place is kind of questionable, so you might have better luck than that person.

For answer no 1

can the SMS between the seller & buyer used to prove the person is selling something and ask buyer to transfer the money to his bank account.

For answer no 2

i think it's hard to track

For answer no 3

if we can proved that seller is scam our money as well as their bank detail provide. police will do necessary to black list & freeze their account is it TRUE, correct me if i'm wrong
