yuktsair, thank you for the detailed information, much appreciated. I bought a Halo unit, intend to keep it for a while. I intend to get further advise from the National Housebuyer's Association (http://www.hba.org.my) this Saturday. Their office is only open from 1-5 pm on Saturday. If any buyer wants to get good advice on their rights as a buyer of Halo/Sunday, please join me tomorrow at the Advice Centre of National House Buyers Association tomorrow afternoon. I should be there at about 3pm. They don't open everyday, only Saturday afternoon 1-5pm. Not sure whether it is every Saturday, though.

To the buyers of Halo/Sunday units,

I visited the Advice Centre of HBA on Saturday afternoon, together with another buyer. We explained the situation we were in, in terms of the late payment interest charged by the developer and inability to move into our unit yet bcos no CCC. Their advice was two fold.

Firstly with regards to the late payment interest, we need to individually write to the Loan Agreement lawyers and ask them for a sequence of events from the day we applied for the loan up to the finalization of the loan agreement. Based on the sequence of events, we can then ascertain the cause of the delay in finalizing the loan agreement. If delay is on the part of the developer, the we can request to reverse this charge. Having said that, my personal advise is to pay up everything first to enable getting the keys to your unit and inspect ASAP so that you can list out all defects for developer to rectify - this is important because the DLP is only 6 months!

As for the CCC issuance, basically the developer's architect is responsible for submitting the relevant forms to MBPJ. Once MBPJ is satisfied that all is in order, MBPJ will give a "tiada halangan" letter to the Architect who will then issue the CCC. So, the crucial matter here is to see how we can expedite this process. To do this, we should use the ADUN for this area to call for a meeting with MBPJ, Developer, Developer's Architect and us buyers to get some clarity on this process. MBPJ doesn't want to be accused of delaying the process as it is bad publicity for them, likewise for the architect.

For this meeting to be called for, we have to get at least 10 buyers together. Please PM me if you are a buyer and once we have enough of us, we can meet soon to take this matter further.

I just received an email from developer (staff name - Nurfatin Nadhrah) stating that appointment for key collection is only from 28th August onwards. If this is so, how can the developer deem it that VP is 2 weeks from notice given as per their letter dated 25th June?? Surely they can't hide behind the SPA if they can't actually physically handover, right?

Has any Halo/Sunday buyer here collected the keys & inspected their unit? According to Fatin, they have been handing over keys since 25th June and they are handing over about 20 units each day. I made full settlement two days ago and developer said the earliest date available is 28th August. Firstly, why is it they are only able to hand over 20 units a day? Surely they can put more resources into handing over at least 50 units a day, right? It is really unfair to "deemed" VP 14 days after notice given (25 June) when they can't even physically hand over....

Is there any way we can insist that monthly service charge be waived until keys are collected?

I know I still can't move in, even if I get the keys today bcos no CCC but I feel like I am being conned by all their deceptions. Really good lesson learnt here! The price better shoot up once the whole place is ready.

My concern about the legality of what they are doing is this - on its own, it seems fine to say buyer has 14 days to collect keys/take VP within 14 days from notice, as per the SPA. But in this case, the developer does not seem ready to hand over the unit! I paid up everything they asked for 2 days ago and yesterday was told the earliest date possible is 28 August. Another buyer was told any day from 10 August onwards. So that makes me think they are still doing up the units.

As a buyer, how can we determine the date MBPJ gave the building approval? Is the developer obliged to provide buyers with a copy of the building approval letter?

Cafe21 is correct. Developer informed that Overall Building Plan was approved on 23 March 2012, which is the date of commencement of the 42 months.

Personally, I wouldn't buy any new launches from Mammoth. There are rumours they have cash flow problems and the first project to kena would be their new launches. I am sure whatever funds they have w0uld be used to ensure current projects are completed properly. Remember, the SPA does not follow HDA format and they bill you upon COMMENCEMENT of each stage of construction not completion. Many loop holes and you end up having to take VP earlier than expected, start paying loan installments and service charge and yet can't move in because no CCC! I expect it will be 6-9 months before CCC is obtained. With this in mind, would you dare to buy from them?

For workmanship, please check out their latest VP project - Empire D'sara to ascertain the quality.

Hi plastictemple,

Have you attended the joint inspection for your Halo/Sunday unit? What minor defects did you encounter? Possible to share with us some photos? Was curious whether electric and water connection was completed and how the unit looked. Hope you can share some photos.

My joint inspection is only fixed for end August. The other buyers I know have appointments from mid August onwards.

I'm glad to hear units have started to be handed over. Did they give you a set of keys for you to visit your unit at any time?

Odieboy, you are the first owner who I know that is "quite satisfied" with the condition of your unit. Besides this, what do you think about the condition of the common facilities and the fact that you will not receive your keys until all defects are rectified. Lastly, what do you think about having to pay your housing loan and maintenance charges considering you can't occupy or rent out your unit?
