Hello everyone.
Do i need to apply an license if i wanted to start a small online business like selling clothes?

I thought license only good to use if you want to build confidence on the buyer and as well as getting stock from supplier. but to start a small online business like in lowyat.net n lelong.com.my I dont see a need of it.

yup... but i think better register,,, now only RM70 wat if u go SSM...15min-20min done... say if something big biz/projek come along the way...atleast u have Enterprise to make it official... means u have prepare 1 step further..

yerp.. with registering your company, or even have a company name, it will look more professional. but if you planning to start the business purely online, through lelong, mudah, or a blog, i dont think need to.

but do you have a market group? if not, just setup a mudah,lelong, or blog to test market. then if business if good, why not register to make it look more professional..

Agree that it is better to open a company. However, if you are just starting and have no volume of sales yet, just start by using your own name first. You can always open a company when there are many sales. The hassle of opening a company is the accounting and taxation part.

Better practise now by keeping all receipts, invoices and other documents.

I heard that authorities are hunting down those who sell online without a proper company registration, not sure how serious they are on this.

Anda menjalankan perniagaan internet tetapi tidak berdaftar dengan Suruhanjaya Syarikat Malaysia (SSM)? Jika benar, anda fikir boleh selamat dengan terus berniaga tanpa berdaftar?

Jika itu tanggapan anda, perhatikan kenyataan terbaharu Timbalan Menteri Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan, Datuk Rohani Abdul Karim.

Menurut hmetro.com.my, dalam tempoh dua tahun lalu kerajaan sudah mengambil tindakan terhadap 400 individu yang menjalankan perniagaan menerusi Internet kerana tidak berdaftar dengan SSM.

Web berita itu yang memetik Pertubuhan Berita Nasional (Bernama) melaporkan Rohani sebagai berkata, kesemua mereka dihadapkan di mahkamah mengikut Seksyen 12 (1) (a) Akta Pendaftaran Perniagaan 1956 (Pindaan 2001) yang membawa hukuman denda maksimum RM50,000 atau penjara maksimum dua tahun.

“Individu atau syarikat yang menjalankan perniagaan menggunakan laman web atau Internet sebenarnya tidak terkecuali dan mesti mendaftarkan perniagaan mereka,” katanya.

Menurut beliau, tindakan undang-undang itu bertujuan melindungi pengguna daripada sebarang unsur penipuan selain memastikan peniaga mematuhi etika perniagaan.

Menurut hmetro.com.my, Rohani berkata, kerajaan menerusi Suruhanjaya Komunikasi dan Multimedia juga sentiasa memantau laman web yang menjalankan perniagaan bagi mengesan pihak yang gagal mendaftarkan perniagaan mereka.

“Kita mahu golongan ahli perniagaan mempunyai kesedaran bahawa mereka mempunyai tanggungjawab dan kod etika yang harus dipatuhi supaya pengguna tidak menjadi mangsa penipuan,” katanya.

Justeru, jika anda peniaga internet, jangan ambil mudah. Berdaftarlah dengan SSM dan berniagalah secara beretika tanpa sebarang bentuk penipuan.

Thanks for all the 2 cents ... =) anyway by registering i can start the business already rite.? no need to apply and summit anything rite.. coz i scare if i take stock from overseas they will confiscate my stock..

You can even register your business online if you want. Just go to www.ssm.com.my and look for e-lodgement. Bit of a hassle to setup, but at least you don't have to go to SSM.

Downside, you'd still need to get the original documents from SSM if you want to open a bank account.

that sounds sweet as it get quite crowded at the SSM.... so can we register online and then later go for collection on the docs?
