I belive that is from the studio MS purchased from Nintendo (UK based Rare, makers of Perfect Dark). MS has their own studio long before entering the console war.

I agree with that.
Example:
MechAssault: Phantom War (NDS)
Ages of Empires: The Age of Kings (NDS)
And Rare (a MS studio) hiring people to make NDS games.

Bleh! All this extra space just allow the developers to be more sloppy in their programming.

Actually you only need to flick your wrist to play unless the game told you otherwise. Some of the games support normal controller as well (example: SSB: Brawl).
