 Occupation Permit, Land title?

Hi guys. My gal and i bought a house and its been way over a year now closing to 2 years. The house was completed about 3 years plus ago. Why till today there is no occupation permit / land title?

Ok, since its under loan... that means by right the land title is held by the bank right? Now, how about the OP cert? Why there this long overdue delay????

I approached the developer and they kept buying time... I seriously do not know what to do.

Occupation permit and land title is different thing. Before you can move in, you need a occupation permit to move in, as it is a permit certify that the house being built is in safe sound condition.

I think what you are asking is the land title. Are you buying apartment/condo/flat or what? If you are buying high-rise buildings, normally it takes a few years to process. I have some units of apartment, and i just recently got one title from a few units. Roughly it will take up 5-10 years to process (For sabah state, I dont know others).

Bought a house. So what you are saying is that, the land title will come in a couple years time? What about the occupation permit? I still hv not got mine. But the house already move in.

Are you referring to Temporary Occupational Lease (TOL)...which means your property is a leasehold one?

Or are you referring to the CFO which is the certification by the local council that essentially says that the bldg is fit for occupation ( to live in)?

Legally, you can't. Anyway, people always renovate their houses before the Occupation Permit. If the house is safe and sound after the renovation, then there should not be a problem. But, if your house is not structural safe sound after the renovation, then you cannot claim any damages from the developer.
