nah, the 38kbps is a lie.. from the total downloaded, seems it's way faster. (and from the bandwidth usage).

Question is, even if the file's uploaded somewhere you guys still gotta download 14-20gb worth of data and still will be limited to your isp cap.. As the patcher is actually really good.. Wont you guys still gonna face the same prob???
