THERE ARE NO BETA 3.0 FIRMWARE FLOATING AROUND FOR FREE, unless you have sign up as an approved Apple iPhone developer and have access to the beta build from within your account login.

No matter how they want to spin it, rename it or insinuate it as, beta or otherwise, those are not legal.

EDIT: If you worked for Apple, your Premium Reseller company would wring their neck dead telling you about the nature of what is approved and what is not. That alone is already the prerequisite. And for someone who had worked for Apple before, you readily accept some third-party shady method to update your iPod Touch, rather than the approved way from Apple AppStore? Were you instilled with the right attitude and frame of mind when you "worked for Apple before"? rolleyes.gif

That loophole was plugged by Apple but not before the vulturing folks managed to get their free copy, and that is less than 24hrs after 3.0 was released.

If you got that from your "developer friend" without paying for the USD99 Developer's Kit to allow access to it, both you and your "developer friend" is at fault. The ToC/EULA explicitly mention this is by access of the said proprietor of the account alone, and if abused, may give cause for Apple to revoke his developer license without reimbursement of that USD99.

The point here is, simply put, you did not pay for what you are supposed to. And to that term, to me , that is considered "stealing".At this point in time, there are TONS of reviews, videos, even indepth discussion and description, text or video-based, on what 3.0 can do, and you can easily refer to those articles to make up your mind on whether to pay and upgrade or to stay at 2.2.1. The excuse of "I want to try it first so I pirate" is a thinly veiled excuse at trying to sound and be legit when the whole activity behind it is already breaching the law.

Look. He got his firmware from his developer friend. Do you know what are the terms and condition that is tied to the developer license for you to use it? One of it is that access to the content within your developer login is explicitly used by the licensee ONLY(meaning his developer friend only and only him), and for testing purposes only. I would also like to think that, since these developers HELP Apple beta-test the firmware build, that they WILL be given access to the final, finished version of the firmware once beta-testing is done. THAT is why the firmware file started downloading on his iTunes, because his firmware file is tied DRM-wise to a developer account signature and allows him to access via iTunes AppStore to get the final build, a.k.a the firmware 3.0 file that HE WAS SUPPOSED TO PAY FOR. The Developer's Kit costs USD99 for these exclusive access, don't tell me they dont get the final firmware build once they themselves have beta-tested it? Think, man think! doh.gif

Also, if Apple can trace back the firmware DRM to his developer friend, imagine what they would do to his developer license? Just because he wants to "try out the OS3.0" without paying.

Again, all of you are trying to justify an already wrongful act. Just because I mistakenly get a Big Mac at McDonald's when I only redeem a free coupon for a Beef Burger, does not make it right for me to gobble down on Big Mac and pretend nothing is wrong. The ethical and the right thing to do is return the Big Mac to the counter, or pay for the extra cost. Don't spin this into "whatever falls off the shelf and nobody's seeing, it is okay to pick it up and put it in my pocket" thing.

With the attitude of freeloading Malaysians these day, I don't see it wrong to assume (as compared to how you have assumed his innocence) that "free is free, as long as it downloads for me" attitude is prevalent here. Have you not seen how many posts and threads DavidGary has deleted, invisibled and moderated in regards to piracy, and illegal acts of downloading here? And you still want me to assume the best for all the things happening around this part of the forum? rolleyes.gif

Unless he can prove me otherwise, or does his purchase legitmately, I stand by my statement. And I give people props and praise for their good work and good deeds as well, those who earned it, deserved it. The opposite goes to the "freeloaders".

Stop accusing Apple for being in the wrong here. You are.

Point #1 - You got it from your developer friend. He is not supposed to do so.

Point #2 - You did not pay for what is supposed to be paid.

Apple's mechanism of sending firmware files for licensees of the Developer's Kit have already been explained by me. You did not pay for the USD99 Developer Kit, but you have access to this. By you having access to your developer friend's files, when you are not supposed to, your developer's friend license should be revoked. End of story.

Would you reveal who your "developer friend" is? Probably not, because of the "saving one's own skin" attitude that permeates around here, even your own skin when it comes to paying USD9.99 for the firmware upgrade. Would you actually pay for the firmware? God knows, and all I have to go is by your own words, and words are pretty useless, unless you hold credibility around here.

Long story short, you try to make yourself look like you've done nothing wrong when your act, together with your developer friend's account, is on the wrong side of the law. Whether that is intentional, or ignorant, or perhaps both, nobody but yourself knows. But accountability-wise, you are accountable for all your actions, everybody is. You just see it as something trivial and "nothing much" when acts like does not have an apparent damage to anyone but only to Apple's side.

Hence my point. Read what I posted. It is not the "damage to Apple" , it is the mentality around here that needs changing. No wonder Apple dont even bother to look past one eye at us and take us seriously and launch a proper iTunes Store, when Malaysians are gleefully leeching at will.

Respect the rule, and this incident would not had happened. The developer friend would have continued using his license according to the terms he agreed upon, and Gadiylim would have just have to spend USD9.99 on the upgrade and everybody's happy. Why complicate things by doing things through "the backdoor", and all this sneaking around treading on grey areas?

I take your absence as the assumption that your American iTunes account is already activated and you are busy browsing apps to get/purchase. My own attempt at creating a new account also results in delay of about 12 hours before the verification email is in my mailbox.

I was hoping for more than this "touch-and-go". As much as you being critical about Apple's delays, it would help the community here more if you could share your thoughts on the new account creation, than just "wham bam thank you ma'am". wink.gif

You dont really have to know where it is located, unless you want to use that firmware for jailbreaking. Just click "Restore" and iTunes will do the rest for you.

Will be going to Jakarta and Melbourne tomorrow. Got a few "kirim" orders from the folks around here (BSG BD Complete, wink wink!, already got mine two weeks back), and I'm planning to get the 64GB iPod Touch 3rd Gen. for myself, in Melbourne while I'm there. RRP is AUD549. Cant wait! rclxm9.gif

I have the iPod Touch 64GB in my hands now. Bought it while I was in Melbourne airport. JB Hifi in downtown Melbourne has it at AUD546, Big W notches it down further to AUD526, but the clincher is while at the F1rst Shopping area in the airport. AUD499, coupled with airport staff discount privileges of 10%, drops it down further to AUD449, which is at the exchange rate of AUD1 = RM3.05 I changed my currency to, adds up to RM1,369! RM430 cheaper than the "nowhere-to-be-seen" advertised price of RM1,799 at local stores here.

Cheap, and item already in hand, compared to the "taxed like mad and still under Customs" situation locally here. Life is good! thumbup.gif

The iPod is syncing in now, will be getting clear-case protection tomorrow.

They are buying "leftovers", unaware that the refreshed versions are incoming. See how the other guy who proclaimed the "selling hot like goreng pisang" never did come back and say anything? He's probably happy with his purchase, and thought that the price "drop" is a good deal, unaware that the new "version" is about to "drop in".

The moniker "3G" or "third generation" here can be misleading. The 8GB version is still sporting the OLD processor and lacking several new features of the 32GB and the 64GB version, particularly the "Voice Control". So everyone here is right and wrong, depending on what you claim as a "third generation 8GB iPod Touch". The hardware is still the same as the second generation 8GB iPod Touch, but the firmware has been updated to 3.1.1. Only the 32GB and the 64GB version has the new features and processor upgrade.

I'm keeping track of the "release" of this iPod Touch shipment from their Customs prison, not for their on-shelf availability for local consumption here, but more of a reflection of seeing how "fast" the Customs work on their "prisoner release" procedure. Reason being, the Customs are also "holding ransom" the whole Beatles Remastered Stereo and Mono Box sets under the excuse of having to "review" the singular DVD that was included in these sets.

To the Customs, they can exercise their power and flex their muscles for all I care, but flex them expeditiously, they are holding the bloody line for consumers and their purchases. If not enough manpower, get some. All this delays are just generating discord and further disgust directed their way. They are already under the category of "powermongering feces" in my book, together with a "select group" of people in this very forum as well.

Just bought the new iPod Nano 16GB Product [RED]! She's a beauty! Also tested the new iPod Touch. The screen not bad, good viewing angle! I'm tempted to get one to avoid draining my iPhone 4 battery while gaming on Game Center. Kancheong!

Going off to the Apple Store L'Opera in a bit. I'll make up my mind while in the train later. sweat.gif
