hi.. i want to check about cooling off period for gym memberships... is it applicable in Malaysia?

a friend signed up for Myoga Mid Valley on 29th April... then on 30th April her office advised that they have corporate rates at California Fitness at only RM90. Since Myoga & California Fitness both belongs to same management, she has requested to change to CF instead. Unfortunately, the gym not only says that they will not refund her deposit of RM300 paid but will also take legal actions against her since she signed the membership agreement.... she's very upset now that the gym has actually threatened that as a step to make her stay with them... it's a full year membership that she signed up for...

your view on this??

thats really messed up. One reason why I will never join gyms like celebrity fitness, california fitness, etc. Why should we sign this type of agreements in the first place?

You could also ask your friend to get her company to call up the management (since both are from the same management) and threaten to pull out if they don't help your friend transfer her membership.

Don't be intimidated by them, they will only bully your friend more if they smell fear wink.gif. GIVE THEM HELL! Rm300 is a lot of money!

yeah... she's upset not cause of the RM300 but because they force her to join the gym for the full out period of 12 months!! furthermore they are not threatening her sleep.gif

ask your friend to talk to the manager, they just want to make business & how dare they threathen your friend!!!

tell them you are also going to make a complaint to your company and posibly blacklist them.

It's not just local gyms, but overseas ones too - ie make you sign up for long term, and threaten all sorts of things when you want to withdraw.

However, I have not heard of any gym actually pursuing with legal action, probably because it's not cost-effective and it will not be good for their public relations.

So maybe you can threaten them back and say if they take legal action, you will make very loud noises and make it very public via every channel you know. smile.gif

but countries like the US have got cooling off period... and consumer protection is strong...
